1. ADVERTISING PROMOTION “Ramadan - time for wish fulfillment. Win certificates for appliances and other prizes” (hereinafter referred to as the “Promotion”) is carried out among an indefinite circle of people in order to create and maintain interest, form a positive image of the trade and retail network Korzinka, and also in order to increase sales of private labels “365 Kun” and “Iz Korzinki” products. The promotion is not a lottery or gambling, and does not require Participants to pay a participation fee.

3. 1. Promotion period: from March 9, 2024 to April 6, 2024 (hereinafter also referred to as the “Promotion Period” or “Promotion Period”).

3. 4. The period for determining the Winners of the promotion: from March 19, 2024 to April 16, 2024 in accordance with the Prize Draw Schedule specified in clause 9. 2 of these Promotion Rules.

3. 5. All periods specified in these Rules are calculated according to the time of Tashkent, Republic of Uzbekistan.

 

4. TERRITORY, PROMO SITE AND INFORMATION PROCEDURE

4. 1. The promotion is carried out on the territory of the Republic of Uzbekistan (hereinafter referred to as RUz. ) in the Korzinka, Korzinka DISKONT and Smart supermarket chains located on the territory of the Republic of Uzbekistan, with the exception of Korzinka DISKONT supermarkets operating under franchise and located at the addresses: Republic of Karakalpakstan, Nukus city, Ernazar Alakuz street, building 162 and Kashkadarya region, Shakhrisabz city, Maftunkor street, building 35 (hereinafter referred to as the “Territory of the Promotion”).

4. 2. Participants are informed about the procedure for participating in the Promotion, the terms of the Promotion (including their changes, additions), and the rules of the Promotion:

5. PROMOTION PARTICIPANTS

5. 1. The Promotion can be attended by legally capable individuals aged 18 years and older: citizens of the Republic of Uzbekistan and foreign citizens with a residence permit in the Republic of Uzbekistan and residing in the territory of the Republic of Uzbekistan, registered in the Loyalty Program of the Korzinka retail chain (hereinafter referred to as the “Loyalty Program” ), who are the holder of a valid/active Loyalty Card of the Korzinka retail chain (hereinafter referred to as the “Loyalty Card” or “Korzinka Plus Loyalty Card”), (hereinafter, above and further together – “Participants”, and individually – “Participant”).

5. 2. The following are not allowed to participate in the Promotion:

• employees who have a labor relationship with the Organizer or Technical Partner;
• persons recognized as affiliated with the Organizer of the Promotion;
• employees and representatives of third parties who have established civil and other relations with the Organizer and related to the organization and (or) conduct of the Promotion, the sale of promotional products;
• close relatives, full and half (having a common father or mother) brothers and sisters of the above persons;
• persons who have not complied with the terms of these Promotion Rules;

5. 3. If it is revealed that persons who do not comply with the conditions of clause 7. 1 of these Rules and other sections of these Rules participate in the Promotion, the Organizer has the right to refuse such persons to participate in the Promotion and/or receive a prize.

 

6. PROMOTION PRIZE POOL

6. 1. The prize fund of the Promotion is formed at the expense of the Organizer’s funds and includes Weekly prizes and the Main Prize (hereinafter referred to as the “Promotion Prizes”).

6. 4. The appearance of the Promotion prizes, their size, design, packaging color and other characteristics may not coincide with the images presented in promotional materials and with the personal expectations of the Participants. 6. 5. The Organizer does not issue cash equivalents of Prizes, and replacement with other Prizes is not made.

 

7. CONDITIONS AND PROCEDURES FOR PARTICIPATION IN THE PROMOTION

7. 1. In order to take part in the Promotion, the Participant must complete the following sequence of actions during the Promotion Period specified in Section 3 of these Rules:

Purchase the Promotional product specified in clause 5. 1 in the Promotion Territory of these Rules, in the amount of: 200, 000 (Two hundred thousand) soums or more in 1 (one) fiscal receipt, during the period specified in clause 3. 2. of these Rules, in any store of the supermarket chain “Korzinka”, “Korzinka” DISKONT and “Smart”, specified in clause 4. 1. of these Rules, using a physical loyalty card of the trade and retail chain “Korzinka”, “Smart” and “Korzinka Mahalla” or a virtual loyalty card of the trade and retail chain “Korzinka” and “Smart” “Korzinka Mahalla”, registered in the KorzinkaGO application (hereinafter – “Loyalty card” and/or “Loyalty card of the Korzinka retail chain”). Promotional products in the Organizer's fiscal receipt must be designated by name in accordance with clause 5. 1. of these Promotion Rules, as well as when purchasing, the person purchasing the Promotional product must use a physical Loyalty Card or a virtual Loyalty Card registered in the KorzinkaGO application.

7. 2. *If goods are returned to the supermarket, the buyer loses the right to participate in the promotion.

7. 3. The number of purchases made by the Participant is not limited.

7. 4. The more Applications submitted by the Participant (purchases made using different fiscal receipts) to participate in prize draws in the Promotion during the relevant periods specified in clause 8. 2 of the Rules (section “Period of purchase of Promotional Products”), the higher his chances of becoming the Winner of the Promotion (owner Prize/Prizes of the Promotion).

7. 5. 8. DETERMINING THE WINNERS OF THE PROMOTION

- 1 (one) Main Prize Draw (hereinafter referred to as the “Main Draw”) according to the Promotion Prize Draw Schedule (hereinafter referred to as the “Prize Draw Schedule”), defined in clause 8. 2 of these Rules.

8. 2. During the entire registration period, the loyalty card numbers of the Promotion participants, containing the participant’s personal data (full name, phone number), are entered into the Korzinka Plus loyalty card number database*

8. 4. Each Main Winner will be notified via a phone call from the Promotion Organizer’s number +99878 888-14-14, to the Main Winner’s phone number assigned to the physical Korzinka Loyalty Card or the virtual Korzinka Plus Loyalty Card registered in the Korzinka application.

If the telephone number of the Main Winner of the Promotion is out of reach, or the Main Winner of the Promotion does not answer the call within 48 hours from the moment the Organizer determines the Main Winner, or for any other technical reasons beyond the control of the Organizer of the Promotion, and also if the Main Winner does not gives consent to the processing of his personal data by the Organizer of the Promotion, then the Main Winner loses his chance to win, without the opportunity to challenge the decision of the Organizer of the Promotion, and the winning Application of the Participant will be canceled by the Organizer. In this case, the Prize will be re-assigned to the Alternate Winner. If there is no communication with the Alternate Winner or the Alternate Winner violates the terms of the Promotion or the Alternate Winner otherwise does not comply with the terms of the Promotion, the Prize passes to the next Alternate Winner.

The mobile phone number assigned to the Participant when registering a physical Loyalty Card of the Korzinka retail chain or a virtual Korzinka Plus Loyalty Card registered in the Korzinka application must be retained by the Participant for the entire duration of the Promotion specified in Section 3 of these Rules. In case of absence, alienation of the mobile phone number to third parties, change of the registered mobile phone number, the Winner loses the right to receive the Promotion Prize. Repeated registration with a different phone number is not allowed.

 

9. CONDITIONS/PROCEDURE FOR RECEIVING PRIZES

9. 1. The Prize will be awarded upon presentation of the original identification document of the Winner (valid civil passport or ID card), if the data specified by the Winner when registering the physical Korzinka Loyalty Card or the virtual Korzinka Plus Loyalty Card registered in the Korzinka application, as well as the physical or virtual Korzinka Plus Loyalty Card used by the Winner when purchasing Promotional products. The Winner's passport must contain an individual identification number (IIN), a personal identification number of an individual (PINFL), the full and accurate address of the actual place of permanent (temporary) residence of the Winner. If the Winner does not have an individual identification number (TIN), personal identification number of an individual (PINFL) and/or the full and accurate address of the actual place of permanent (temporary) residence of the Winner, in the Winner’s identity document (valid civil passport/ID card), data on the complete and accurate address of the actual place of permanent (temporary) residence of the Winner and/or TIN of the Winner are provided by the Winner additionally.

9. 2. If the Winner does not claim his prize within 30 (thirty) business days after the end of the Promotion prize draws, the Organizer has the right to cancel this Prize.

9. 3. When registering/receiving the Prize, the Winner undertakes to sign all necessary documents (related to the process of registration/receipt of the Prize), which will indicate personal information and personal data of the Winner, and also undertakes to provide the Organizer with originals and/or copies of all necessary documents (related to the registration process / receipt of the Prize), where personal information and personal data of the Winner will be indicated.

9. 4. The refusal of the Promotion Winner to sign the necessary documents and/or perform other legally significant actions, including refusal to provide the required documents, including, but not limited to, personal data, when receiving prizes, is regarded as the Winner’s refusal to receive the prize.

9. 5. The organizers reserve the right to refuse to provide the Winner with a prize if the Winner fails to comply with all the requirements and conditions provided for in the procedure for receiving prizes in these Rules.

9. 6. Prizes are issued no later than 10 (days) business days after the prize drawings of the Promotion. Working days are considered to be days from Monday to Friday inclusive. Prizes are issued from Monday to Friday from 9: 00 to 13: 00 and from 14: 00 to 18: 00 (except for weekends and public holidays established in the Republic of Uzbekistan).

9. 7. Place and address for issuing Weekly prizes: Republic of Uzbekistan, Tashkent, Yakkasaray district, M. Tarobiy street 40. Prizes will be awarded to winners from the regions of the Republic of Uzbekistan through the delivery service of the Promotion Organizer.

9. 8. Replacement of Weekly Prizes, the Main Prize of the Promotion with cash or any other equivalent is not allowed. Prizes cannot be exchanged or returned.

9. 9. The winner of the Promotion who does not comply with the terms of these Rules loses the right to receive Prizes. In this case, the Promotion Organizer, at its own discretion, disposes of such Prize.

9. 10. The winner of the Promotion loses his acquired right to receive the corresponding prize without any compensation, including cash, in the following cases, regardless of the time at which these circumstances became known:

9. 10. 1. if the Promotion Winner is found to be in violation of these Rules before the corresponding prize is awarded to him;

9. 10. 2. if the Promotion Winner orally or in writing, using electronic or other means, declares his refusal to receive the prize;

9. 10. 3. if it is impossible to identify the Promotion Winner;

9. 10. 4. after 3 (three) unsuccessful attempts to contact such Winner;

9. 10. 5. if the Winner refuses to transfer his personal data to the Organizer;

9. 10. 6. if the Promotion Winner does not own a registered physical Loyalty Card of the shopping and retail network Korzinka or a virtual Loyalty Card of the shopping and retail network Korzinka in the Korzinka application used/applied when purchasing a Promotional product;

9. 10. 7. if the Winner refuses to provide within the specified time frame all the necessary information and documents specified in these Rules.

9. 11. The ownership of the prize passes to the Winner from the moment such a prize is awarded to him; the Promotion Winner independently takes all measures related to the further use of the Promotion prize transferred to him.

9. 12. If it is impossible for the Promotion Winner to send/receive the Prize within 30 (thirty) business days after the end of the Promotion prize draws for reasons beyond the control of the Organizer, including, but not limited to:

• removal of the email address by the Winner or loss of access to the email address;
• The winner provided an incorrect email address;
• loss of the right to a mobile phone number assigned to the Participant/Winner when registering a physical Loyalty Card of the Korzinka trade and retail network or a virtual Loyalty Card of the Korzinka trade and retail network in the Korzinka application;
• failures, malfunctions, errors in the operation of computer systems, mail servers, in the Internet provider network;
• failures, errors and problems on the Internet;
• lack/blocking of the Internet, electricity;
• blocking of postal services and (or) websites with the mailing addresses of the Promotion Winner by government authorities, recognizing them as extremist and (or) terrorist;

then in this case such a Promotion prize is considered unclaimed and cannot be claimed by the corresponding Winner again, and will be used by the Promotion Organizer at its own discretion.

9. 13. The Organizer and Technical Partner of the Promotion is not responsible for the work of Internet providers, telecom operators, any errors of postal, courier or other services, as a result of which postal and electronic items were not received or arrived late, were lost or damaged.

9. 14. Promotion Participants are responsible for ensuring that their mobile phone numbers are available for incoming calls and incoming text messages throughout the Promotion Period.

9. 15. The right to receive the Promotion Prize cannot be transferred by the Promotion Winner to a third party. It is not allowed to replace the won prize with other prizes of the Promotion. Cash equivalents of prizes are not paid out.

9. 16. The number of prizes in the Promotion is limited and is the number specified in these Rules. The Organizer's obligations to issue prizes to Participants are limited to the total size of the Prize Fund specified in clauses 6. 2 and 6. 3 of these Rules. In this connection, the Promotion Participant cannot demand any compensation, including monetary compensation.

9. 17. Payment of personal income tax under this Promotion is carried out in accordance with the current legislation of the Republic of Uzbekistan.

9. 18. Making other payments, paying fees to the budget of the Republic of Uzbekistan, commissions and other additional payments arising from the Winner in connection with the receipt, possession and disposal of the Promotion prize is carried out by the Winner independently.

 

10. COSTS. LIMITATION OF LIABILITY

10. 1. The organizer and technical partner are not responsible for:

10. 1. 1. Failure (untimely fulfillment) by Participants of obligations related to participation in the Promotion and (or) receipt of prizes;

10. 1. 2. Failure to familiarize Participants with the Promotion Rules, as well as failure to familiarize themselves with the results of the Promotion;

10. 1. 3. Failure to receive letters, calls and/or electronic messages from Participants, including through the fault of the postal service, communication organizations, as a result of technical problems and/or fraud on the Internet and/or communication channels used during the Promotion;

10. 1. 4. Non-receipt (untimely receipt) from the Winners of documents and/or information necessary to receive Prizes;

10. 1. 5. Receiving from Participants incomplete and/or incorrect contact and/or other information, personal data necessary for the purpose of conducting the Promotion and transferring Prizes;

10. 1. 6. For any technical failures, malfunctions, preventive maintenance, etc. of cellular operators, Internet providers that arose not through the fault of the Promotion Organizer;

10. 1. 7. for any expenses and (or) losses incurred by the Participant in connection with participation in the Promotion and (or) receipt of the Prize.

10. 1. 8. in the event of force majeure circumstances (force majeure), including the introduction of a state of emergency and/or sanitary and epidemiological restrictions/prohibitions in connection with COVID-19.

10. 1. 9 All Participants of the Promotion shall independently pay for all and any expenses incurred by them in connection with participation in the Promotion (including, without limitation, costs associated with using the services of mobile telecom operators, the Internet, obtaining any information about the Promotion, purchasing promotional product, etc. ).

10. 1. 10 The Organizer and the technical partner are not responsible in relation to any disputes regarding the right to prizes of the Promotion. In any case, the final decision regarding disputes is made by the Organizer and such a decision is not subject to appeal.

The organizer and the technical partner do not enter into a dispute in the event of a dispute about the ownership of a mobile phone number, email address, promotional product, physical or virtual Korzinka Plus Loyalty Card, check to a particular person. All such disputes are resolved between the parties to the conflict independently and at their own expense.

11. The organizer and technical partner are not responsible for the work of Internet providers, telecom operators, any errors of postal, courier or other services, as a result of which postal and electronic items were not received or arrived late, were lost or damaged.

11. 1. The Organizer and the technical partner are not responsible for the further use of the Prize provided by the Promotion Winner after its receipt, and for the inability of the Promotion Winner and/or to use the provided Prize for any reason. Responsibility for the quality of the Prize and their warranty service (if provided) lies with their manufacturer.

11. 2. The received Prize can only be used by persons who are Participants. Any actions, operations, transactions where the Prize will be the subject of the transaction or a means of payment are not permitted.

11. 3. The Organizer and technical partner, at their own discretion, taking into account the provisions of the current legislation of the Republic of Uzbekistan and these Rules, may invalidate all applications for participation, as well as prohibit further participation in this Promotion to any person who forges or benefits from forging documents on participation in the Promotion, or acts in violation of these Rules, acting or carrying out improper actions with the intent to annoy, insult, threaten or harass any other person who may be associated with this Promotion, and also violates the requirements of the current legislation of the Republic of Uzbekistan.

11. 4. The Organizer reserves the right to introduce additional technical restrictions at any time to prevent fraud in the Promotion. If any attempt at dishonest behavior by any Participant is detected, his winnings will be canceled and the Participant himself will be suspended from further participation in the Promotion.

11. 5. The Organizer independently assesses the integrity of participation in the Promotion based on the technical capabilities available to the Organizer and taking into account the provisions of the current legislation of the Republic of Uzbekistan and these Rules.

11. 6. The organizer and the technical partner are not responsible in the event of force majeure circumstances, such as natural disasters, fire, flood, military actions of any nature, blockades, quarantine measures related to the pandemic, significant changes in legislation in force in the territory of the Promotion, and other circumstances beyond the control of the Organizer and the technical partner, in the manner prescribed by the current legislation of the Republic of Uzbekistan.

 

12. PERSONAL DATA

12. 1. By taking part in the Promotion, the Participant undertakes to indicate accurate and current (reliable) data, and also, acting of his own free will and in his own interests, provides the Organizer and his authorized person with consent to the collection, processing, transfer, including cross-border, use, storage personal data and other information provided by the Participant in cases and to the extent provided for by the legislation of the Republic of Uzbekistan, in particular the Law of the Republic of Uzbekistan. “On personal data” dated June 21, 2019 No. ZRU-547, and these Rules.

12. 2. To participate in the Promotion and receive a Prize within the Promotion, the Participant must provide the Organizer with information (including his personal data) defined by this Offer (Rules) in the manner prescribed by the current legislation of the Republic of Uzbekistan.

By participating in the Promotion, each Participant thereby confirms his consent to the use by the Organizer of the information provided by the Participant, including but not limited to personal data, with marketing and/or any other advertising activities that do not contradict the current legislation of the Republic of Uzbekistan, in particular, for free use of his name, surname, photograph, interview or other materials about him for advertising/marketing purposes, including the right to publish (name and photograph) in the media, any printed, audio and video materials, interviews with the media, in case of receiving a Prize, as well as for sending information, messages (including advertising) and so on, without any restrictions on territory, time and method of use, and such use will in no way be reimbursed by the Organizer.

12. 4. By taking part in the Promotion, the Promotion Winner grants the Organizer and his authorized person the right to use his personal data, including, but not limited to, photographs, interviews, phone numbers, e-mail and (or) other materials about him in advertising and (or) marketing purposes of the Organizer, in particular, but not limited to: The Organizer and its authorized person are granted the right to publish the Participant’s data and materials in the media, any printed publications, the Internet, without any restrictions on territory, time and method of use; and such use will in no way be reimbursed (paid) to the Participant by the Promotion Organizer.

12. 5. By taking part in the Promotion, each Participant agrees, without any time limit, to receive SMS messages, news and other information/advertising messages (mailings) from the Organizer and his authorized person in the future to his mobile phone number, e-mail address.

 

13. OTHER TERMS

13. 1. As an Application for participation in the Promotion, the Organizer also accepts and records purchases made through the Korzinka GO online delivery service. To do this, the phone number to which the loyalty card is registered must be linked in your personal account.

13. 1. 2 As an Application for participation in the Promotion, the Organizer does not accept or record checks paid through the Zoodpay installment service, using gift cards from Korzinka, as well as checks paid with accumulated bonuses on the Korzinka Plus loyalty card.

13. 2. By taking part in the Promotion, the Participant confirms familiarization with and his full and unconditional/unconditional agreement with all the Rules and conditions of participation in the Promotion.

13. 3. The rules of the Promotion may be changed and/or supplemented by the Organizer during the entire period of the Promotion. The Organizer of the Promotion reserves the right at any time to unilaterally make changes to the terms of the Promotion, the Rules and terms of the Promotion, and the Organizer has the right to terminate the Promotion early. Changes and/or additions to the Rules for the Promotion are possible if they are approved by the Organizer and published on the Organizer’s website.

13. 4. The Organizer of the Promotion has the right, at its sole discretion, without explaining the reasons to the Participants and without entering into correspondence with them, to invalidate any actions of the Participants of the Promotion, as well as to prohibit further participation in the Promotion, to refuse to receive the Prize to any person in respect of whom the Organizer has reasonable grounds of suspicions that the Participant is falsifying data or benefiting from any falsification of data.

13. 5. If a situation arises that allows for ambiguous interpretation of these Rules, any controversial issues and / or issues not regulated by these Rules, the final decision is made by the Organizer in accordance with the requirements of the current legislation of the Republic of Uzbekistan.

13. 6. In everything that is not provided for by these Rules, the Organizer and Participants/Winners of the Promotion are guided by the current legislation of the Republic of Uzbekistan.

13. 7. The measures of liability of the parties, as well as the procedure for resolving disputes, are established in accordance with the requirements of the current legislation of the Republic of Uzbekistan.

13. 8. The validity period of this Public Offer is until the end of the Promotion period.
