PUBLIC OFFER OF MOBILE APPLICATION KORZINKA GO

In accordance with part 2 of Art. 369 and Art. 426 of the Civil Code of the Republic of Uzbekistan, this document is an offer of Lean Trade Solutions LLC, location address: Uzbekistan, Tashkent, Chilanzar-1 district, house 6 (hereinafter referred to as the Seller), addressed to an unlimited circle of persons (hereinafter referred to as the Buyer / Buyers) on the conclusion of an agreement for the retail sale of goods by remote means (hereinafter referred to as the Agreement).

The Agreement is considered concluded on the terms of this Public Offer from the moment the Seller receives payment for the Buyer's order. Payment for the Goods confirms that the Buyer agrees with the terms of the Public Offer.

By accepting the terms of this Public Offer, the Buyer agrees that he has read the Personal Data Privacy Policy https://korzinka.uz/page/korzinka-go-policy/.

1. Terms and definitions

1.1. Goods - an object of sale (thing), not seized and not limited in civil circulation and presented for sale in the online store by placing it in the appropriate section of the online store. The subject of sale and purchase may be food and non-food Goods marked in the online store as Goods with the status "in stock". Images of the Products posted in the Online Store may differ from the actual images.

1.2. Online Store - an information resource on the Internet owned by the Seller, located at https://korzinka.uz/go/, as well as the Korzinka Go Mobile Application.

1.3. Korzinka Go mobile application - software installed (downloaded) on a mobile device (smartphone, tablet, etc.) based on the IOS and Android platforms, which is a collection of data and commands designed to operate on a mobile device or gadget. The owner of the Korzinka Go Mobile application is the Seller.

1.4. The Buyer - a person who intends to order or purchase the Goods solely for personal, family, household and other needs not related to business activities and who placed the Order in the Online Store, or indicated in the Order as the recipient of the Goods.

1.5. The seller - Lean Trade Solutions LLC, location address: Uzbekistan, Tashkent, Chilanzar-1 district, building 6.

1.6. Order - a completed request of the Buyer for the purchase and delivery to the address specified in the request or pickup from the Seller's stores of the Goods selected in the Online Store, sent via the Internet.

1.7. Delivery Terms - the conditions governing the delivery and payment of the Goods, which are listed in the Public Offer.

1.8. Personal account - a set of pages of the website https://korzinka.uz/go/ and the Korzinka Go Mobile application, created as a result of the Buyer's registration and associated with the Buyer's account on the website https://korzinka.uz/go/ and in the Korzinka Go Mobile application, in which The Buyer has access to interaction with the Seller on the conditions proposed by the Seller.

1.9. A Promo Code - a specially created unique alphabetic and/or numeric code that gives its holder the right to reduce the amount of the Order (get a discount) by the amount of the Promo Code.

2. General provisions

2.1. This Public Offer regulates the relationship between the Seller and the Buyer, and also determines the procedure for the retail sale of Goods through the Online Store, and is the Seller's Public Offer addressed to Buyers to individuals. When jointly mentioned, the Seller and the Buyer are also referred to as the Parties, and each separately as a Party.

2.2. The relations between the Buyer and the Seller are subject to the provisions of the Civil Code of the Republic of Uzbekistan, the Law of the Republic of Uzbekistan "On the Protection of Consumer Rights" dated April 26, 1996 No. 221-1 and other regulatory legal acts.

2.3. The Seller reserves the right to unilaterally amend the terms of this Public Offer with their preliminary publication on the website. The address of the current version of the Public Offer on the Internet: https://korzinka.uz/page/korzinka-go-oferta/.

2.4. The use of the resource of the Online Store to view and select the Goods, as well as to place an Order is free of charge for the Buyer.

2.5. The Public Offer does not regulate the quality and some other essential parameters of the Goods.

3. The procedure for the purchase and sale of goods

3.1. The Buyer's order can be placed on the website of the online store https://korzinka.uz/go/ or through the Korzinka Go mobile application.

3.1.1. The Buyer places the Order through the Personal Account. To create a Personal Account, the Buyer must register on the website https://korzinka.uz/go/ or in the Korzinka Go Mobile Application. The Buyer confirms that he is familiar with the terms of the sale of the Goods through the online store and provides the Seller with reliable information about himself: name, phone number, delivery address, and also selects the date and time of delivery (interval) from those offered.

3.2. After receiving the Order, the Seller proceeds to process the Order in accordance with the data in the Order. The Seller checks the availability of the Goods from the Order and, in case of their absence, removes the missing Goods from the Order, and also contacts the Buyer for information. If the Seller cannot contact the Buyer using the phone number provided by him until the completion of the Order assembly, the Order is not further adjusted, and the Goods that are not in stock are deleted. If the Goods in the Order are not available and the Seller cannot contact the Buyer using the phone number provided by him, the Order is cancelled.

3.3. The Seller has the right to add to the Order the required number of packages or other packaging for the proper delivery of the Goods to the Buyer. The cost of packages or other packaging may also be reflected in the Order.

3.4. If the Goods have not expired, the Goods are considered to be of high quality, and the Seller has the right to put this Goods in the Order, and is not responsible to the Buyer for this.

3.6. The Seller and his representatives have the right to contact the Buyer at the provided phone number to clarify the details of the Order.

3.7. The Seller has the right to engage third parties to deliver the Order and transfer information about the address, phone number of the Buyer and other personal data of the Buyer necessary for the delivery.

3.8. If the Courier arrives at the Buyer's address specified in the Online Store, but cannot deliver the order due to the Buyer's unavailability or incorrect delivery address, the Order is considered delivered. The Seller reserves the right not to return the money for the Order in case of online payment, in case of cash payment and suspected fraud, to block the Buyer's Personal Account.

3.9. The store from which the delivery is made to the Buyer and the displayed range of goods in the online store depend on the address chosen by the Buyer and may change if it changes.

3.10. The conditions for the use of Promo Codes are regulated by the Online Store separately and may change unilaterally.

4. Cost and payment procedure for the Goods

4.1. The total cost of the Order consists of the price of the Goods in the Online Store or in the Korzinka Go Mobile Application, the cost of delivery and the cost of packaging in accordance with clause 3.4 of this Public Offer.

4.2. The price of the Goods is indicated next to the Goods in the online store and may differ depending on the type of the Seller's store.

4.2.1. The price of the Goods may differ depending on the specified delivery address.

4.2.2. The price of the Goods in retail stores and in the online store may differ.

4.3. The Seller has the right to change the Price of the Goods in the Online Store unilaterally:

1) after revaluation;

2) independent choice by the Buyer of the Seller's store. At the same time, the price for the Goods ordered by the Buyer is not subject to change if this order is confirmed by the Seller.

4.4. Payment for the Goods by the Buyer is made in Uzbekistani sums in the following ways:

Upon delivery of the Goods to the Buyer's address:
- by online payment from the Buyer's bank card in the online store;
- by bank card if the courier has a payment terminal;
- in cash to the courier upon receipt of the Order.

4.5 When the Buyer places an order in the Online Store and selects the “Payment by card” option, the amount of the order is held on the Buyer’s card, as well as an additional 10% as a reserve in case of overweight goods.

4.5.1 The balance of the reserve, not used to cover the excess, is returned within 24 hours after the fiscal check is broken.

4.6. When paying for the Goods by online payment from the Buyer's bank card in the Online Store, the payment is debited after the completion of the Assembly of the order and the receipt of the fiscal receipt.

4.6.1 After the fiscal receipt has been cleared, cancellation and return of the Order in the Online Store is not possible if the Seller has fulfilled all the conditions of this agreement

4.7. When the Buyer purchases the Goods remotely, if there is a weighted Goods in the Buyer's Order, the price of the weighted Goods is determined after weighing the Goods and may differ up or down from that specified in the Order.

4.8. The Buyer is considered to have accepted the terms of this Public Offer from the moment the full payment for the Order is made.

5. Terms of delivery of the Goods

5.1 The Buyer chooses a two-hour delivery interval within which the Seller delivers the Order.

5.1.1 The nearest interval closes 1.5 hours before its end.

5.2. The Buyer can place an Order during the working hours of the online store. The Order will be processed on the same day if the Buyer places the Order no later than 1.5 hours before the end of the Korzinka Go store, from which the delivery will be made. If the Buyer placed the Order later, the Order will be processed the next day during the working hours of the Korzinka Go store that delivers.

5.3. The approximate standard delivery time is 2 hours from the moment the Buyer places the Order. The Seller will make every effort to comply with the date and time of delivery agreed with the Buyer in the Order, however, delays in delivery are possible due to unforeseen circumstances that occurred through no fault of the Seller.

5.3.1. The Buyer has the right to choose the next day delivery of the Order. In this case, the delivery will be carried out at the two-hour interval chosen by the client.

5.3.2. The actual delivery time of the Order may deviate upwards from the estimated time specified in the Public Offer by 24 hours, which will not be considered a breach of obligations by the Seller.

5.4. The risk of accidental damage to the Goods passes to the Buyer at the time of transfer of the Goods to the Buyer, another person indicated as the recipient of the Order, or a person authorized by the Buyer and/or the recipient.

5.5. The Goods are handed over to the Buyer or the person indicated as the recipient of the Order, or to a person authorized by the Buyer and/or the recipient. Together with the Goods, the Buyer or other recipient of the Goods specified in this clause is given a cash receipt. The Buyer and/or recipient receives a check and confirms that they have no claims to the quantity, appearance, completeness and shelf life of the Goods. After acceptance of the Goods by the Buyer and / or the recipient, the Seller does not accept claims regarding the quantity and appearance of the Goods.

5.6. When transferring the ordered Goods, paid online in the Online Store, the Seller's representative who delivers the ordered Goods has the right to require the presentation of an identity document of the Buyer. These actions are aimed at preventing fraud.

5.7. The Seller has the right to set the minimum amount of the Order for delivery. Detailed conditions are calculated and displayed to the Buyer when choosing an address and method of delivery, depending on the following conditions:
- the time of day when the delivery will be made,
- the distance between the delivery address and the Korzinka Go store from which the delivery will be made;
— the workload of the Korzinka Go store from which the delivery will be made.

The Buyer confirms acceptance of the minimum Order amount for delivery when placing the Order.

5.9. The Buyer has the right to issue a return of the Goods through the support service, regardless of the brand of the Goods.

5.9.1. The possibility of a return is available within 24 hours after delivery to the Buyer. Specific return conditions are agreed upon by the Buyer and the Seller when making an online return. The Seller has the right to refuse the Buyer to return the Goods online if the Seller believes that the Buyer is abusing the right to return the Goods online.

5.10. When placing an Order, the Buyer instructs the Seller to pack the Goods in the required number of paid packages in order to ensure the completeness and safety of the Goods and reduce delivery times.

6. Rights and obligations

6.1. Buyer's rights:

6.1.1. Require the Seller to comply with the terms of this Public Offer.

6.1.2. Place Orders in the Korzinka Go Mobile Application.

6.1.3. Other rights provided for by this Public Offer.

6.2. Buyer Responsibilities:

6.2.1. Timely pay and receive the Order in accordance with the terms of this Public Offer.

6.2.2. Provide the Seller with reliable and necessary information for the Seller to fulfill its obligations. For any failure by the Seller to fulfill the obligation from this Public Offer due to inaccurate or incorrect data in the Order, the Seller is not responsible.

6.2.3. Do not provide third parties with access to the Personal Account on the website of the Online Store or in the Korzinka Go Mobile Application.

6.2.4. Products may contain ingredients that cause personal allergic reactions and intolerances. By placing an order for the Goods on the Seller's website, the Buyer confirms that he has familiarized himself with their composition and has no claims against him.

6.2.5. Before placing an Order on the website of the Online Store or in the Korzinka Go Mobile Application, familiarize yourself with the content and conditions set forth in this Public Offer, as well as with other conditions specified on the Online Store website or in the Korzinka Go Mobile Application, including prices for the Goods, and the conditions for the formation of the full cost of the Seller's Goods, established by this offer.

6.2.6. Avoid conflict situations, threats to life and health, the use of physical force against the Seller’s employees and / or persons involved by the Seller in cooperation (couriers) and other aggressive behavior, including causing damage to the property of the Seller’s employees and / or persons involved by the Seller in cooperation (couriers).

6.3. Seller's rights:

6.3.1. Suspend or terminate the Buyer's access to the Personal Account if the Seller reasonably believes that the Buyer violates the terms of this Public Offer, including clause 6.2.6. of the Public Offer and/or performs illegal actions on the website of the Online Store or in the Korzinka Go Mobile Application.

6.3.2 Refuse to deliver the Goods to the Buyer by canceling the Order if the Seller reasonably believes that the Buyer violates the terms of this Public Offer, including clause 6.2.6. of the Public Offer and/or performs illegal actions on the website of the Online Store or in the Korzinka Go Mobile Application.

6.3.3. Temporarily stop the operation of the Online Store and the Korzinka Go Mobile Application, as well as partially restrict or completely terminate access to the Online Store and the Korzinka Go Mobile Application until the necessary maintenance or moderation is completed. The Buyer is not entitled to claim damages and other funds for such temporary restriction of the availability of the Online Store and the Korzinka Go Mobile Application.

6.3.4. Properly fulfill their obligations under this offer.

6.3.5. Unilaterally, without notifying the Buyer, at any time change the terms of this Public Offer, including the terms for the delivery and pickup of the Goods, the minimum amount of the Order, the cost of delivery, as well as other conditions specified in the online store and in the Korzinka Go Mobile application. At the same time, the Seller is not entitled to change the conditions for the Buyer who has placed the Order on the website of the Online Store or in the Korzinka Go Mobile Application as part of the confirmed Order, including the conditions for the price of the Goods.

6.3.6. Without agreement with the Buyer, transfer its rights and obligations under the Agreement concluded with the Buyer to third parties.

6.3.7. Make changes to the description, characteristics, names, appearance and packaging of goods without prior notice to the Buyer.

6.3.8. Do not accept a customer complaint after 24 hours after delivery of the order

6.4. Responsibilities of the Seller:

6.4.1. Comply with the terms of the contract of sale and the requirements for the Goods;

6.4.2. Transfer the Goods to the Buyer in accordance with the selected and executed Order and these terms;

6.4.3. Bear full responsibility to the Buyer for the execution of the Order before the transfer of the Goods to the Buyer;

6.4.4. As soon as possible, inform the Buyer about the need to adjust the Order in the absence of the Goods ordered by the Buyer.

6.4.5. Comply with the terms of the Personal Data Privacy Policy published on the website: https://korzinka.uz/page/korzinka-go-policy/ .

6.4.6. The Seller guarantees that the Goods transferred to the Buyer are of good quality, are not used and meet the quality requirements adopted in the Republic of Uzbekistan.

6.5 In the event of a partial or complete return of the Goods to the Buyer for an Order paid in cash, the Seller has the right to return the money in another form: in the form of non-cash money, with a Promo Code or by accruing bonuses to the Korzinka Plus loyalty card

7. Responsibility of the Parties

7.1. The Parties are responsible for non-fulfillment or improper fulfillment of their obligations in accordance with the terms of the Agreement and the legislation of the Republic of Uzbekistan.

7.2. The Seller shall not be liable for non-fulfillment or improper fulfillment of its obligations due to failures in telecommunications and energy networks, malicious programs, the quality of cartography, errors in cartographic services, as well as unfair actions of third parties aimed at unauthorized access and / or disabling of software and / or the hardware complex of the Online Store and the Korzinka Go Mobile Application. However, the Seller undertakes to take all reasonable measures to prevent such interruptions.

7.3. In the event of force majeure, documented by the relevant authorities, the parties are exempt from the execution of this Public Offer.

7.4. The Seller's Online Store contains the results of intellectual activity and means of individualization equated to them, which are provided with legal protection, including, but not limited to: texts, photographs, graphics. The Seller owns the exclusive rights to use the content of the Seller's website, except as otherwise noted in the content of materials published on the website. The Buyer has no right to make changes, publish, transfer to third parties, participate in the sale or assignment, create derivative works or otherwise use, in part or in full, the content of the Seller's website.

7.5. The Seller is not liable, cannot act as a defendant in court and does not compensate for losses incurred by the Buyer due to the action or inaction of third parties.

7.6. The Seller shall not be liable in case of incorrect selection by the Buyer of the characteristics or properties of the Goods that are the subject of the Agreement.

8. Other terms

8.1. The legislation of the Republic of Uzbekistan applies to the relationship between the Buyer and the Seller.

8.2. These conditions are binding on the parties in the event of an order, return, exchange by the Buyer of the Goods from the Seller.

8.3. The Buyer guarantees that these conditions are clear to him, and he accepts them unconditionally and in full.

8.4. The invalidity of any provision of this Public Offer does not entail the invalidity of the remaining provisions.

8.5. In everything that is not provided for by this Public Offer, the Parties are guided by the legislation of the Republic of Uzbekistan.
