1. GENERAL PROVISIONS

1.1.   Alpen Gold: Fly for positivity promotional campaign (hereinafter referred to as the Promotion), is conducted among an indefinite number of persons in order to create and maintain interest, form a positive image and consumer demand for products under the Alpen Gold® trademark, as well as to increase sales of these products.

1.2.   The Promotion is not a lottery, betting, sweepstakes, gambling, or other game based on risk as required by the Law of the Republic of Uzbekistan.

1.3.   The offer to participate in this Promotion is addressed to an unlimited number of persons.

 

2. INFORMATION ABOUT THE CUSTOMER, ORGANISER, TECHNICAL PARTNER OF THE PROMOTION

2.1. The Customer of the Promotion: Mon'dalis Kazakhstan LLP (hereinafter referred to as the Customer), a legal entity established under the laws of the Republic of Kazakhstan (hereinafter referred to as RoK), BIN 080240015871, located at the address: A05B8Y6, Republic of Kazakhstan, Almaty, 101 Tole Bi Street.

2.2 Organiser of the Promotion: The Executor of the Promotion is Urban Media LLP (hereinafter referred to as the Organiser), a legal entity established under the laws of the Republic of Kazakhstan, BIN 050840004119, located at the address: Republic of Kazakhstan, 050004, Almaty, 135, Zhibek Zholy Avenue, ATK Zhibek Zholy, Block 2, 10th floor, office 2104, acting by order of the Customer.

2.3 Operator of the Promotion: «UrbanMediaAlliance» LLP (hereinafter referred to as the Operator), a legal entity established under the laws of the Republic of Uzbekistan, located at the address: Republic of Uzbekistan, 10000, Tashkent, 77 Bobur Street, BC Bobur77, 1st floor 116 office, TIN 306708505.

2.4 Information partner of the Promotion (hereinafter referred to as the Information partner): IE ANGLESEY FOOD LLC, a legal entity established under the laws of the Republic of Uzbekistan, TIN 202 099 756, located at the address: Republic of Uzbekistan,100066, Tashkent, 57 Turob Tula Street, Territory of Beshegoch Bazaar.


3. PROMOTIONAL CAMPAIGN PERIOD

3.1.   Promotional Campaign Period: from 9th October 2023 to 5th November 2023 inclusive (hereinafter referred to as the Promotional Campaign Period).

3.2.   The term for acquisition of Promotional Products is from 00:01 hours on 9th October 2023 to 23:59 hours on 5th November 2023 inclusive (hereinafter referred to as the Promotional Campaign Period).

3.3.   The term for determining the winners of the Promotion: from 18th October 2023 to 8th November 2023 (inclusive), according to the Prize Drawing Schedule specified in clause 9.2. of the Promotion Rules.

3.4.   Deadline for awarding prizes to the winners of the Promotion: until 25th November 2023 (inclusive).

3.5.   All terms and times specified in these Rules shall be calculated according to the time of Tashkent, Republic of Uzbekistan.



TERRITORY, PROMOTIONAL SITE AND INFORMATION PROCEDURE

 

4.1 . The campaign shall be held within the territory of the Republic of Uzbekistan (hereinafter referred to as the RUz) Korzinka, Korzinka DISKONT and Smart supermarkets chain located in the territory of the Republic of Uzbekistan, except for Korzinka DISKONT supermarkets operating under franchise and located at the addresses: Republic of Karakalpakstan, Nukus, 162 Yernazar Alakuz Street and Kashkadarya region, Shakhrisabz city, 35 Maftunkor Street (hereinafter - the Promotional Territory).

4.2 . The Participants shall be notified about the procedure for participation in the Promotion and terms and conditions of the Promotion (including their modification and amendment):

1) on the official website of the Information Partner of the Promotion https://korzinka.uz/ (above, hereinafter referred to as the Site)

2) by other means at the choice of the Operator, Organiser and (or) Customer.

3) email for questions about the Promotion: consumercareeua@mdlz.com.

4.3 The Organiser and (or) the Customer shall be entitled to amend the terms and conditions of the Promotion at any time, as well as terminate the Promotion ahead of schedule and publish additional information on the Promotion. The updated (additional) information on the Promotion and its terms and conditions shall be posted on the Website within 3 (three) working days from the date of approval of such change (update) by the Customer.

4.4 The Customer, Organiser, Operator and Information Partner reserve the right not to enter into written negotiations or other contacts with the Participants of the Promotion, except in cases provided by these Rules, acting legislation of the Republic of Uzbekistan, and in case of disputes.

4.5 The Organiser and the Customer are fully responsible for the conduct and results of the Promotion.

4.6. IE Anglesey Food LLP and Korzinka retail network stores do not accept appeals and claims regarding the Promotion and are not responsible for the conduct and results of the Promotion.

5.1 

5.1.   The Promotion shall apply to all products under the Alpen Gold® trademark (hereinafter referred to as the Promotional Products):

5.2 The promotional products must be purchased by the Participant within the period specified in clause 3.2. of the Promotion Rules in Korzinka retail chain and/or the online supermarket Korzinka Go, as well as according to the Prize Drawing Schedule specified in clause 9.2 of the Promotion Rules (Term for acquisition of promotional products).


6. PROMOTION PARTICIPANTS

 

6.1. Capable individuals aged 16 years and older can take part in the Promotion: citizens of RUz and foreign citizens who have a residence permit in RUz and reside in the territory of RUz, registered in the Loyalty Programme of Korzinka retail chain (hereinafter referred to as the Loyalty Programme), who are holders of a valid/active Loyalty Card of Korzinka retail chain (hereinafter referred to as the Loyalty Card or Korzinka Plus Loyalty Card), (here, above and hereinafter collectively referred to as the Participants, and individually as the Participant).

6.2 Participation in the Promotion of persons aged 16 to 18 years is allowed only with the consent of parents, guardians, or other persons specified in this clause of the Rules, provided they have full legal capacity.

6.3 The following persons are not allowed to participate in the Promotion:

-employees of the Customer and (or) the Organiser, Operator and Information Partner;

-individuals recognised as affiliated with the Organiser, Operator, Information Partner, and Customer;

-employees and representatives of third parties having established civil and other relations with the Organiser, Operator, Information Partner, and Customer, and/or related to the organisation and (or) holding of the Promotion, and sale of the Customer's products;

-close relatives of the above persons;

- stateless persons and citizens of other states who do not have a residence permit in RUz;

6.4 In case of revealing the fact of participation in the Promotion of citizens who do not meet the conditions of clauses 6.1., 6.2., 6.3. and other sections of these Rules, the Organiser and/or the Operator shall be entitled to refuse such persons to participate in the Promotion and (or) to receive the prize.

 

 

7. PROMOTIONAL PRIZE FUND

7.1. The prize fund of the Promotion shall be formed at the expense of the Customer's monetary funds and includes Weekly and Grand prizes (herein, above and hereinafter referred to as the Promotion prizes):

7.1.1.   Weekly Prizes (hereinafter referred to as the Weekly Prize):

§ Apple Iphone 14 Pro max 128GB Black - four (4) pieces for the entire Promotion Period;

§ Korzinka Certificate with a face value of 300,000 sums - 112 (one hundred and twelve) pieces for the whole Promotion Period;

7.1.2.        Grand Prize:

§ «Trip to Thailand for two persons for the amount of 55,000,000 soum» (hereinafter also referred to as the Grand Prize): 1 (one) during the entire Promotion Period.

* The Trip to Thailand for two for the amount of 55,000,000 soum is a certificate for the amount of 55,000,000 soum for the purpose of traveling to the Kingdom of Thailand for two by acquirement of this tour by means of this certificate being provided by the Promotion Operator. The single purpose of this certificate is the trip for two to the Kingdom of Thailand, and it may not be used for any other purposes.

7.2.   The number of prizes for the entire Promotion Period is limited to the number specified in this section of the Rules.

7.3.   The Customer reserves the right to change the Prize fund of the Promotion, including changing the number, configuration, type, and other characteristics of the prizes. In this case, the value of the new prizes shall be commensurate with the value of the replaced prizes.

7.4.   The appearance of the Promotion prizes, their design, colour, decoration and any other characteristics may not coincide with the images presented in the promotional materials or personal expectations of the participants.

7.5.   The manufacturer (supplier) of these goods (services) is responsible for the quality of goods (services) provided as prizes for the Promotion.


 

8. TERMS AND CONDITIONS AND PROCEDURE FOR PARTICIPATION IN THE PROMOTION

8.1     In order to take part in the Promotion the following conclusive actions have to be taken within the period specified in clause 3.2. of the Rules.

1) to register or be registered in the Korzinka Plus loyalty programme, according to the rules of this programme, placed in the Korzinka.uz mobile application and on the Website.

2) to purchase in 1 (one) fiscal cheque at least 1 (one) unit of the Promotional Products specified in clause 5.1 of these Rules, during the period specified in clause 3.2. and clause 9.2. (Term for Acquisition of Promotional Products) of these Rules, in any store of Korzinka retail chain and/or through the online supermarket Korzinka Go with mandatory application of the Korzinka Plus Loyalty Card;

8.2 The quantity of the Promotional Products purchased by the Participant is not limited;

8.3. 1 (one) fiscal cheque, with at least 1 (one) unit of the Promotional Products specified therein, purchased during the relevant period specified in clause 9.2. hereof (Term for Acquisition of Promotional Products) shall be 1 (one) Application for participation in the relevant Prize drawings (hereinafter referred to as the Application) specified in clause 9.2. hereof. The Rules (Date for Determination of Winners and Number and Type of Prizes sections).

1 (one) fiscal cheque, with 1 (one) unit or more of the Promotional products indicated in it = 1 (one) Application for participation in the Promotion prize drawings.

8.4 If 1 (one) fiscal cheque contains more than 1 (one) unit of the Promotional products, this fiscal cheque will be considered as 1 (one) Application for participation in prize drawings of the Promotion;

8.5 The more Applications submitted by the Participant (purchased Promotional Products) to participate in the Drawings during the relevant periods specified in clause 9.2. of the Rules (Term for Acquisition of Promotional Products), the higher the chances to become the Winner of the Promotion (the owner of the Prize/Prizes of the Promotion).

8.6 If the Participant became the Winner of the Promotion (the owner of any Weekly Prize of the Promotion), the Application (fiscal cheque), on which the Prize was won, is automatically cancelled. In order to take part in the Weekly and Grand Prize drawings of the Promotion the Participant needs to purchase products again according to the terms of the Promotional Campaign Rules

 

 

9. DETERMINATION OF THE PRIZE WINNERS

9.1          During the entire Promotional Period, the Organiser shall conduct the following drawings in accordance with the Promotion Prize Drawing Schedule (hereinafter referred to as the Prize Drawing Schedule) defined in clause 9.2. of these Rules:

- 4 (four) Weekly Prize Drawings (the Weekly Drawing);

- 1 (one) Grand Prize Drawing (hereinafter referred to as the Grand Drawing).

9.2          The winners of the draws for the Weekly Prizes and the Grand Prize shall be determined by the Organiser randomly by means of a random number generator posted on the Internet at Random.org among the Participants who have fulfilled the conditions specified in Section 8 of the Rules during the relevant Periods (hereinafter referred to as the Term for Acquisition of Promotional Products) specified in the Prize Drawing Schedule below:

*The Prize Drawing Schedule of the Promotion may be amended by the Organiser, Operator, and Information Partner taking into account weekends and public holidays established by the legislation of the Republic of Uzbekistan, as well as at occurrence of circumstances beyond the control of the Information Partner, Customer, Operator and the Organiser of the Promotion.

9.3     The Prize drawings are held only if the number of the participants registered by the date of the relevant draw (see clause 9.2 of the Rules) exceeds the number of prizes to be drawn on that date by at least 2 (two) times.

9.4     If the number of registered participants by the Drawing date does not meet the conditions of clause 9.3 of these Promotion Rules, the drawing shall be postponed to the next Drawing Date, and the total number of prizes to be distributed on the next Drawing Date shall be increased by the number of prizes not distributed in the previous period.

9.5 On the Date of the Weekly Draw and Grand Draw the Organiser shall determine the Grand Prize Winners and Reserve Prize Winners (hereinafter referred to as the Alternate Winner) of the Draws.

9.6 The number of Grand Prize Winners in each Weekly Prize Draw and Grand Prize Draw shall be equivalent to the number of prizes drawn in such drawings.

The number of Alternate Winners within each draw is:

          - Weekly Drawing - twenty nine (29) Alternate Winners,

          - Grand Drawing - two (2) Alternate Winners.

Alternate winners shall be determined for the purpose of possible replacement of the Primary Winner in case the Primary Winner violates the terms and conditions of the Promotion or otherwise fails to comply with the terms and conditions of the Promotion.

9.7 The Organiser, Customer, Operator and Information Partner shall not disclose the names of the participants who were included in the list of Alternate Winners of the Prize Draws.

9.8 Within 3 working days from the date of determining the Prize Winners, the Operator contacts the Winners by making a call from the mobile number +998900074433 to the Korzinka Plus Loyalty Card's designated phone number of the Winner in order to obtain the necessary information for prize delivery. If the phone of the Winner of the Promotion is out of range, or the Winner of the Promotion does not answer the call within 72 hours, or for any other reasons of technical nature beyond the control of the Organiser of the Promotion, the Winner shall lose their chance to win, without the possibility to challenge the decision of the Organiser of the Promotion, and the Prize will be reassigned to the Alternative Contender. In case of no communication with the Alternative Contender, the Prize will go to the next Alternative Contender and so on.

9.9 The Organiser and Operator shall have the right to contact the winners of the draws, both by mobile phone number and email, assigned to their Loyalty Card.

9.10. The mobile phone number assigned to the Participant when registering Korzinka Plus Layalty Card shall be retained by the Participant during the entire Promotional Period specified in Section 3 of these Rules. In case of alienation of the mobile phone number to third parties, change of the registered mobile phone number and (or) email address, deletion and (or) blocking of the e-mail, the Winner (and/or Alternative Contender) shall lose the right to receive the Promotional Prize.

9.11. One (1) participant can receive only one (1) Weekly Prize - Apple Iphone 14 Pro max, 128GB Black for the entire Promotional Period.

9.12. One (1) participant can receive only one (1) Grand Prize - Trip to Thailand for Two for the entire Promotional Period.


 

10. PROCEDURE AND CONDITIONS FOR RECEIVING PRIZES

10.1. To receive the Weekly Prize (Apple Iphone 14 Pro max, 128GB Black and/or Korzinka Certificate with the nominal value of 300 000 (three hundred thousand) soums), the Winner should provide the Operator with the following documents and information about himself/herself not later than 2 (two) calendar days from the moment of receiving the notification from the Operator (clause 9.8. of these Rules):

10.1.1 To provide the following by sending to the Operator's email address Operatoruz@urbanmedia.uz:

1) Surname, first name, patronymic name (if any);

2) Complete and accurate address of the Winner's actual residence.

10.1.2. When transferring the Weekly Prize from a representative of the Operator to the Winner, the Winner must present the originals of the documents below:

- For citizens of the Republic of Uzbekistan:

The original of the Identification card of the citizen of the Republic of Uzbekistan, which must contain the individual identification number (ID) of its holder or the biometric passport of the RUz citizen with a valid term.

- For foreign citizens who have a residence permit in the Republic of Uzbekistan:

Original valid document certifying the residence permit of a foreigner in the Republic of Uzbekistan.

The residence permit of a foreigner in the Republic of Uzbekistan must contain the individual identification number (IIN) of its holder.

If the foreign citizen does not have IIN in the document certifying the residence permit in the Republic of Uzbekistan, the IIN data shall be provided additionally.

2) Korzinka retail chain loyalty card;

The operator or their representative shall takes photos of the ID card of the RUz citizen (on both sides) or biometric passport of the RUz citizen with valid term/ residence permit (on both sides) and Loyalty card (on both sides).

10.1.3 When transferring the Weekly Prize from a representative of the Operator to the Winner, the Winner shall fill in and sign the following documents:

1) The original of the Prize Delivery Certificate (hereinafter referred to as the Prize Delivery Certificate), the form of which will be provided to the Winner by the Operator's representative;

2) The original of the Consent for the transfer of personal data (hereinafter referred to as the Consent for the transfer of personal data), the form of which will be provided to the Winner by the Operator's representative.

10.2 The Grand prize – «Trip to Thailand for two persons for the amount of 55,000,000 soum» shall be awarded to the winner in the form of a Travel Certificate (hereinafter referred to as the «Travel Certificate»). Additionally, the Operator shall inform the winner about the contact details of the travel agency, which on the basis of contractual relations with the Operator or Organiser (hereinafter referred to as the Agency) directly organises the trip to Thailand for the Winner and their accompanying person.

10.2.1 The travel certificate must be activated by the winner no later than 15th December 2023.

10.2.2 To activate the Travel Certificate, the winner must agree with the Agency on the trip details (dates, number of travel days, hotel, meals, dates and times of air travel, airlines, etc.), as well as resolve other formalities related to the organisation of the trip.

10.2.3 If the cost of the trip agreed with the Agency exceeds 55,000,000 (fifty-five million) soums, the Winner shall pay to the Agency the difference between the amount of the Travel Certificate and the cost of the trip selected.

If the cost of the trip agreed with the Agency is less than the amount of the Travel Certificate, the difference will not be reimbursed.

10.2.4 The amount of the Travel Certificate is not divided into several parts and is to be used as a lump sum.

10.2.5 The trip must be made (completed) by the winner by the 1st February 2024. Postponement of the trip to a later date is not allowed.

10.3 In order to receive the Grand Prize, the Winner must provide the following documents and information about themselves to the Operator within 2 (two) calendar days from the day of receiving the notification from the Operator (clause 9.8 of these Rules):

10.3.1 To provide the following by sending to the Operator's e-mail address Operatoruz@urbanmedia.uz:

1) Surname, first name, patronymic name (if any);

2)      Complete and accurate address of the Winner's actual residence.

10.3.2 When transferring the Grand Prize from a representative of the Operator to the Winner, the Winner must present the originals of the documents listed below.

- For citizens of the Republic of Uzbekistan:

The original of the Identification Card of the citizen of the Republic of Uzbekistan, which must contain the individual identification number (ID) of its holder or a biometric passport of the citizen of the Republic of Uzbekistan with a valid term.

- For foreign citizens who have a residence permit in the Republic of Uzbekistan:

Original valid document certifying the residence permit of a foreigner in the Republic of Uzbekistan.

In case of absence of the foreign citizen's IIN in the document certifying the residence permit in RUz, the IIN data shall be provided additionally

2) Originals of valid passports of citizens of RUz (foreign passport) of the Grand Prize Winner and the accompanying person.

Passports on the date of travel must have at least 2 blank pages.

The expiry date of the passports of the Winner and their accompanying person must not be earlier than 30.06.2024.

3) Korzinka retail chain Loyalty Card;

The Operator or their representative shall take photos of the Identification Card of the RUz citizen (both sides) or biometric passport of the RUz citizen with valid term/residence permit (both sides), foreign passports and Loyalty Card (both sides).

10.3.3 When transferring the Grand Prize from the Operator's representative to the Winner, the Winner must fill in and sign the following documents:

1) The original of the Prize Delivery Certificate (hereinafter referred to as the Prize Delivery Certificate), the form of which will be provided to the Winner by the Operator's representative;

2) The original of the Consent for the transfer of personal data (hereinafter referred to as the Consent for the transfer of personal data), the form of which will be provided to the Winner by the Operator's representative.

10.3.4 Other documents and information that may be additionally requested by the Customer and (or) the Organiser and (or) the Operator of the Promotion.

10.4 The Organiser has the right to additionally request from the Prize Winner any other documents and (or) information necessary for the proper implementation of the Promotion.

10.5. The winner of the Promotion who fails to fulfil the conditions of these Rules loses the right to receive the Prizes (Weekly and Grand Prizes). In such case, the Customer of the Promotion shall dispose of such Prize at its discretion.

10.6. The winners of the Weekly and Grand Prizes of the Promotion residing in Tashkent city shall collect the Promotion Prizes on their own at the location of the Operator in Tashkent city.

The address of the location of the Operator or the Operator's representative shall be provided to the Winner additionally.

The Organiser, Operator, Customer, and Information Partner shall not cover the expenses related to travel to the place of receiving the prize.

10.7. The Winners shall collect the Prize(s) within 5 (five) working days from the date of notification of the Winner by the Operator (clause 9.8. of these Rules), and if required to clarify information / obtain documents - from the date of receipt from the Winner of the necessary information (documents) specified in clauses 10.1 and 10.3 and provided such Winner of the Promotion fulfils all conditions of these Rules, but not later than 25th November 2023.

10.8 The delivery of the Weekly and Grand Prizes of the Promotion to the Winners living in the cities of the RUz, except for the city of Tashkent, shall be carried out by the Organiser's representative to the address of actual residence specified by the Winner in accordance with clause 10.1.1 and 10.3.1 of these Rules within 25 (twenty five) calendar days from the date of determination of such participant as the Winner of the Promotion, and if required to clarify information/obtain documents – from the date of receipt of required information (documents) specified in clauses 10.1 and 10.3 from the Winner and provided the Winner of the Promotion fulfills all terms and conditions of these Rules, but no later than 25th November 2023.

All prize delivery costs are at the expense of the Customer.

10.9. The obligations of the Customer/Organiser to deliver the prizes shall be deemed fulfilled:

§ From the moment the Weekly Prizes are handed over to the Winners, as well as the Grand Prize - Trip to Thailand for Two in the form of a Travel Certificate

10.10. Ownership of the Weekly and Grand Prizes shall be vested in the winners from the date of signature

by the winners of the Prize Certificate.

10.11.The right to receive the Promotional Prize may not be transferred by the Prize Winner to a third party.

10.12. From the moment of receipt of the Prize, the winner shall bear the risk of accidental loss or damage,

theft or damage to the prize received.

10.13. The winner of the Promotion loses their acquired right to receive the corresponding prize without any compensation, including monetary, in the following cases, irrespective of the time when these circumstances became known:

1) if the Participant of the Promotion is recognised as a violator of these Rules before the prize is awarded to them;

2) if the Participant of the Promotion verbally or in writing by means of electronic communication declares their refusal to receive the prize;

3) in case of impossibility to identify the Participant of the Promotion;

4) after 3 (three) unsuccessful attempts to contact such Winner (clause 9.8. of these Rules);

5) in case of the Winner's refusal to transfer their personal data to the Organiser/Operator of the Promotion (subclauses10.1.3 and 10.3.3 of these Rules);

6) in case of the Winner's refusal to provide all necessary information specified in clause 10.1 and clause 10.3 of these Rules within the specified terms;

7) in case of non-compliance with the deadlines for independent collection of the Prize specified in clause 10.8 of these Rules.

10.14. In the event that the Promotion Winner is unable to transfer/receive the Prize by 25th November 2023 for reasons beyond the control of the Client / Organiser, including but not limited to:

- The Winner deletes the email address or loses access to the email address;

- The Winner provided an incorrect email address;

- failures, malfunctions, errors in the operation of computer systems, mail servers, in the Internet provider's network;

- Internet failures, errors and malfunctions;

- no/blocked internet, electricity,

such prize of the Promotion is recognised as unclaimed, cannot be claimed by the respective Winner again, and is used by the Customer of the Promotion at its discretion.

10.15. Participants are responsible for ensuring that their mobile numbers are available for incoming calls and incoming text messages throughout the Promotional Period.

10.16. It is not allowed to replace the prize won with other Promotional prizes. The cash equivalent of the prizes shall not be paid. The prizes are not subject to return.

10.17. The number of the Prizes is limited and shall be equal to the number specified in section 7 of these Rules. The Organiser's obligations to issue the prizes to the Participants are limited to the total amount of the Prize Fund specified in section 7.1.1 and section 7.1.2. of these Rules. In this regard, the Participant of the Promotion cannot claim any compensation, including monetary compensation.

10.18. An individual who received the prize within the framework of participation in the Promotion under the public offer, lasting more than 30 days, according to paragraph 14, part 2, article 369 of the Tax Code of the RUz does not pay personal income tax. The Winner shall make other payments and pay fees to the budget of the RUz (or) other countries, commissions and other additional payments arising for the Winner in connection with the receipt, possession and disposal of the Prize on his/her own.

10.19. In case the Winner of the Weekly and/or Grand Prize refuses or for other reasons fails to provide the Operator with the documents and information required under clauses 10.1 and 10.4 of the Rules, as well as if an incomplete set of the required documents (under clauses 10.1 and 10.4) is provided, the Organiser shall be entitlerd to refuse to issue the Weekly and/or Grand Prize to such winner, as well as to dispose of it at its own discretion.

10.20. All Promotional prizes shall be awarded to the winner(s) only if the Rules of the Promotion are duly fulfilled. The winner who fails to fulfil the terms and conditions of these Rules forfeits the right to receive the prize. In such case, the Customer shall dispose of such prize at its discretion.

10.21. Any actions, transactions and deals made by the participant prior to receiving the prizes as well as Promotions where the Promotional prizes or rights associated with them is the subject of the agreement, means of payment or a security interest shall not be allowed.

 

11. PARTICIPANT'S CONSENT TO THE COLLECTION AND PROCESSING OF PERSONAL DATA

11.1 The fact of participation in the Promotion confirms the Participant's unconditional consent to the Promotion Rules, and is also a free, specific, informed and conscious expression of the Participant's consent to the collection and processing of their personal data (hereinafter referred to as the Personal Data and Consent) by the Customer for the following purposes: sending prizes, messages about winning, information about the Customer's products and events, promotional offers to the Participants, as well as for the purpose of marketing analysis, preparation of statistical information, implementation of tax incentives, and other purposes.

11.2 The Participant shall provide Consent in respect of the following Personal Data:

§ surname, first name, patronymic name (if it is indicated in the identity document/residence permit);

§ date of birth;

§ Individual Identification Number (IIN);

§ contact details (email address, mobile phone number, residential address and prize delivery address);

§ any other information voluntarily provided by the Participant.

11.3 The Participant shall provide the Consent to the following activities with Personal Data, performed by automated processing, non-automated processing (without the use of automation tools), mixed method of processing of Personal Data: collection, recording, systematisation, accumulation, storage, clarification (update, change), supplementation, use, extraction, distribution, depersonalisation, blocking, deletion and destruction of personal data, crossborder transfer in foreign countries, as well as any other actions.

11.4 The Participant shall also agree that their Personal Data may be transferred to third parties in order to achieve the goals specified in clause 11.1 of the Rules (under the conditions of confidentiality and security of Personal Data during their processing), including, but not limited to: Technical Partner, Promotional Organiser, members of Mondelēz International group of companies, and other persons processing Personal Data on behalf of the Customer - including in case of crossborder data transfer.

The consent shall be granted for a certain period of time - until the achievement of the goals specified in clause 11.1 of the Regulations.

11.5 The Consent may be withdrawn by the Participant at any time during its validity period by sending a written application for its withdrawal to the Customer's email address: consumercareeua@mdlz.com.

In case of revocation of the Consent, the Customer shall cease processing of Personal Data or ensure the cessation of such processing (if personal data processing is carried out by another person acting on the Customer's instruction/assignment) and destroy Personal Data or ensure their destruction (if Personal Data processing is carried out by another person acting on the Customer's instruction/assignment) within a period not exceeding 30 (thirty) days from the date of receipt of the revocation, except for cases when the Customer has the right to process personal data without the consent of the subject of personal data based on the grounds stipulated by the Law of the Republic of Uzbekistan on Personal Data or other regulatory documents of the Republic of Uzbekistan.

11.6 By taking part in the Promotion, the Participant undertakes to indicate accurate and current (reliable) personal data.

11.7 The Personal Data of the Participants of the Promotion shall be stored and processed in accordance with the requirements of the legislation of the Republic of Uzbekistan, in particular the Law of the Republic of Uzbekistan On Personal Data dated 02 July 2019 No. ZRU-257, during the term required to meet the goals specified in clause 11.1 of the Rules, on conditions of confidentiality and are subject to further deletion/destruction by the Customer, as well as by persons authorised by the Customer.

 

 

12. FINAL PROVISIONS

12.1 The Organiser, Customer, Operator and Information Partner are not responsible for the following:

§   failure (untimely fulfilment) of the Participant's obligations related to participation in the Promotion and (or) receipt of the Prize;

§   failure to familiarise the Participant with the Promotion Rules, as well as failure to familiarise the Participant with the results of the Promotion;

§   failure to receive letters, calls and/or emails from the Participant, including through the fault of the postal service, communication organisations, as a result of technical problems and/or fraud on the Internet and/or communication channels used by the participant during the Promotion;

§   failure to receive (untimely receipt) from the Participants of the information and (or) data required to receive the Prizes;

§   receipt from the Participant of incomplete and (or) incorrect contact and (or) other information, personal data required for the purposes of the Promotion and the transfer of Prizes;

§   any technical failures, malfunctions, preventive maintenance and other technical failures of mobile operators, Internet providers, which occurred through no fault of the Operator, Organiser and Customer of the Promotion;

§   any costs and/or losses incurred by the Participant in connection with participation in the Promotion and/or receipt of the prize.

§   in the event of force majeure circumstances (force majeure) determined in accordance with the legislation oft he Republic of Uzbekistan.

§   in the event that the winner has missed the relevant flight for air travel or has taken other actions that have made it impossible to travel.

§   absence of a valid passport of a citizen of the Republic of Uzbekistan for travelling abroad and the winner and/or their accompanying person's inability to obtain a passport.

§   the winner and/or their accompanying person being prohibited/restricted from travelling outside the territory of the Republic of Uzbekistan or entering the territory of the Kingdom of Thailand, which resulted in the inability to use the Prize won.

12.2 All participants of the Promotion shall pay all and any expenses incurred by them in connection with participation in the Promotion (including, but not limited to the expenses related to the use of Internet, payment for telephone (mobile) communication, receipt of any information about the Promotion, purchase of the Promotion products, etc).

12.3 The Organiser, Operator and (or) Customer of the Promotion shall not be liable in respect of any disputes about the right to the Promotional prizes. The final decision regarding such disputes shall be made by the Customer.

12.4 Neither the Organiser, nor the Customer, Information Partner, or the Operator shall enter into a dispute related to the mobile phone number, email address, Promotional Products, Korzinka Plus Loyalty Card, or winning Cheque to one or another person. All such disputes shall be resolved between the parties to the conflict independently and at their own expense.

12.5 All disputes between the participants and the Organiser and Customer concerning this Promotion shall be regulated on the basis of the current legislation of Republic of Uzbekistan. If the disputes are not resolved through negotiations, the dispute shall be considered at the location of the Organiser (contractual jurisdiction). Participants express their consent to the contractual jurisdiction by participating in the Promotion.

12.6 By participating in the Promotion, the Participant hereby confirms:

1) familiarisation with and agreement to all the Terms and Conditions of Participation in the Promotion.

2) the Customer, Organiser, Operator and (or) Information Partner shall be entitled to edit the materials related to the participant in mass media and internet before placing them without prior agreement with the participant.

12.7 The Customer, Organiser, Operator and (or) Information Partner of the Promotion shall be entitled, at their sole discretion, without explaining the reasons and without entering into correspondence with the participants, to invalidate any actions of the participant(s) of the Promotion, as well as to prohibit further participation in the Promotion, to deny the prize to any person in respect of whom the Customer, Organiser and (or) Information Partner has reasonable suspicion that the participant falsifies data or benefits from any data falsification.

12.8 By taking part in the Promotion, each participant agrees to receive text messages, news and other information/advertising messages (mailings) from the Customer, Organiser, Operator or Information Partner authorised by them during the Promotional Period to his/her mobile phone number, e-mail address. The Participant shall be entitled to refuse to receive the above information at any time by sending a corresponding written message to the email address consumercareeua@mdlz.com.

12.9 In case of a situation that allows ambiguous interpretation of these Rules, the final decision shall be made by the Customer in accordance with the requirements of the current legislation of the Republic of Uzbekistan.

12.10       These Rules are compiled in Russian, English and Uzbek languages. In the event of discrepancies between the texts of the Rules in Russian, English and Uzbek languages, the Russian version shall prevail.

12.11       With regard to any other matters not stipulated by these Rules, the Organiser, Customer, Information Partner, and the Participants of the Promotion shall be guided by the current legislation of the RUz.
