RULES FOR CONDUCTING PROMOTION EVENT
“Celebrate the spring with love in “Korzinka” retail chain”
(hereinafter referred to as the “Rules”)
1. PROMOTION EVENT “Raffaello – Celebrate the spring with love in “Korzinka” retail chain” (hereinafter referred to as the “Event”) is conducted among the general public in order to create and maintain interest, cultivate positive image and consumer demand for the products under “Raffaello” trademark, as well as to increase volume of sales of these products. This event is not a lottery or gambling, and does not require the Participants to make participation fee.
2.INFORMATION ABOUT THE CLIENT, PROMOTER, OPERATOR AND THE EVENT’S TECHNICAL PARTNER
2.1. The Client of the Event is a legal entity, established in accordance with the legislation of the Russian Federation, namely “Ferrero Russia” CJSC, OGRN (Primary State Registration Number) 1025005688113, business address: Russian Federation, 601211, Vladimir region, Sobin district, Vorsha v., “Ferrero” confectionary plant, postal address: 125047, Moscow, Vtoraya Brestskaya Ulitsa, building 8, floor 11, phone number: +7 (495) 961-24-00, fax number: +7 (495) 961-24-10, Taxpayer Identification Number (TIN): 5044018861, KPP (Tax Registration Reason Code): 330250001 (hereinafter referred to as the “Client”). 2.2. The Promoter of the Event is a Limited Liability Company, OOO “Outdoor Media International”, OGRN (Primary State Registration Number) 1027700335717, business address: 3 Bolshoy Savvinskiy Pereulok 9, building 3, Moscow, 119435, postal address: 119435, Moscow, Bolshoy Savvinskiy Pereulok 9, building 3, phone number: +7 495 935-71-50, fax number +7 495 935-71-50, Taxpayer Identification Number (TIN): 7731177750, KPP (Tax Registration Reason Code): 773101001 (hereinafter referred to as the “Promoter”), acting on behalf of the Client.
2.3. Event Operator: Private Entrepreneur “Sattarova Elina Emilyevna”, Tashkent, Mirzo-Ulugbek district, J.Abidova str., building 10, apt. 16. License No. 1728936 dated July 13, 2022, TIN: 578838285 (hereinafter referred to as the “Operator”).
2.4. Media Partner of the Event (hereinafter referred to as the “Media Partner”): IP OOO “ANGLESEY FOOD”, legal entity, established under the legislation of the Republic of Uzbekistan, TIN 202 099 756, registered at: Republic of Uzbekistan, 100066, Tashkent, Turob Tula str., 57. Territory of “Beshyogoch” store.
3. EVENT PERIOD
3.1. The Event Period is March 3 through March 17, 2023 (hereinafter referred to as the “Event Period”).
3.2. Period for purchasing the promotion products: March 3 through March 17, 2023.
3.3. Period for determination of the event winners: March 3 through March 23, 2023 according to the giveaway schedule specified in the Clause 9.2 of the Rules;
3.4. Period for prize distribution: up to and including March 31, 2023.
3.5. All periods specified in the Rules, are defined according to the time in Tashkent, Republic of Uzbekistan.
4. TERRITORY, PROMOTION WEBSITE, AND PROCEDURE FOR INFORMING
4.1. The Event shall be conducted on the entire territory of the Republic of Uzbekistan at “Korzinka”, “Korzinka Diskont” and “Smart” markets of “Korzinka” retail chain, located on the territory of the Republic of Uzbekistan, excluding “Korzinka Diskont” supermarkets, acting under the franchise license and located at the following addresses: Republic of Karakalpakstan, Nukus, Ernazar Alakuz str., 162 and Kashkadarya region, Shakhrisabz, Maftunkor str., 35.
4.2. Information on participation in the Event and the Event terms (including their change or amendment) is provided to the Participants as follows:
1) on the official website of the Event’s Technical Partner https://korzinka.uz/ (hereinafter and hereinbefore referred to as the “Website”)
2) by other means at the discretion of the Operator, Promoter and/or the Client.
3) Email for the Event queries: firstname.lastname@example.org.
4.3. Promoter and/or the Client have the right, at any time, to change the Event terms, terminate the Event before the scheduled date, publish additional information on the Event. Updated (additional) information on the Event and its terms is subject to distribution on the Website within 3 (three) working days from the date of the Client’s approval of such change (update).
4.4. Client, Promoter, Operator and the Media Partner reserve the right to not enter into written negotiations or any other contracts with the Participants, except as otherwise expressly provided in the Rules, applicable legislation of the Republic of Uzbekistan, and in case of disputes.
4.5. Promoter and the Client are fully responsible for the implementation and the results of the Event.
4.6. IP OOO “Anglesey Food” and “Korzinka” retail chain stores do not accept inquiries and claims with regards to the Event and are not responsible for the implementation and the results of the Event.
5. PROMOTION PRODUCT
5.1. The Event shall be conducted toward the following products under “Raffaello” trademark (hereinafter referred to as the “Promotion Product”):
Raffaello Confetteria 90g
Raffaello 100g cake
Raffaello 200g cake
Raffaello Raffaello 240g
5.2. The Promotion Product should be purchased by the Participant within the period specified in the Clause 3.2 of the Event Rules, at “Korzinka” retail chain, according to the giveaway schedule specified in the Clause 9.2 of the Event Rules (Section “Period for purchasing the Promotion Product”)
6. EVENT PARTICIPANTS
6.1 Adult citizens of the Republic of Uzbekistan as well as the persons with the residence permit in the Republic of Uzbekistan, permanently residing in the territory of the Republic of Uzbekistan, registered in the loyalty program and holding the valid/active loyalty card are allowed to participate in the Event (hereinafter and hereinbefore jointly referred to as the “Participants”, individually referred to as the “Participant”).
6.2. The following persons are not allowed to participate:
• employees of the Client, Promoter, Operator or the Technical Partner;
• persons recognized as affiliated with the Client, Promoter, Operator or the Technical Partner;
• employees and representatives of third parties having established civil-law or other relations with the Client, Promoter, Operator, Technical Partner and related to the arrangement and/or conduct of the Event, sales of the Client’s products;
• close family members of the above-mentioned persons;
• Persons without citizenship and citizens of other states without residence permit in the Republic of Uzbekistan.
6.3. In the event of discovery of participation in the Event of such persons not complying with the provisions of the Clauses 6.1., 6.2., 6.3. and other sections of the Rules, the Promoter is entitled to deny such persons to participate in the Event and/or receive the prize.
7. PRIZE FUND OF THE EVENT
7.1. The prize fund of the Event is raised at the expense of the Client’s funds, includes Weekly Prizes and the Grand Prize (hereinafter and hereinbefore referred to as the “Event Prizes”).
7.2. Weekly Prizes:
● Certificate from “Korzinka” retail chain with a nominal value of UZS 100,000 (one hundred thousand) in the amount of 100 (one hundred) pieces for the entire Event Period;
7.4. Grand Prize:
● Apple Iphone 14 Pro – 1 (one) piece for the entire Event Period.
7.5. The Client reserves the right to change the Prize Fund of the Event, including the number, bundling, appearance and other characteristics of the prizes. In this case the prizes must be proportionate in value to the replaced prizes.
7.6. Appearance of the Event Prizes, their size, pattern, color of the package and other characteristics may not match the images on the promotion materials and the personal expectations of the Participants. Manufacturers of these products are responsible for the quality of products, provided as the Event Prizes.
8. TERMS AND PROCEDURE FOR PARTICIPATION IN THE EVENT
In order to participate in the Event, the Participant should execute the following implicative actions, within the Event Period specified in the Clause 3 of the Rules:
8.1. Purchase Raffaello products, 70 g or more, at least 1 piece with 1 (one) fiscal receipt, specified in the Clause 5.1 of the Rules, within the Period, provided for in the Clause 3.2 of the Rules, at any “Korzinka” retail chain store specified in the Clause 4.1 with the use of the loyalty card of “Korzinka” retail chain (hereinafter referred to as the “Loyalty Card” and/or “Loyalty Card of “Korzinka” retail chain);
8.1.1. Number of the Promotions Products purchased by the Participants is not limited;
8.2. Promotion Products in the receipt must be marked with the name according to the Clause 5.1 of the Event Rules;
8.2.1. Only Receipts with the Promotion Products, purchased within the Period, are accepted for purposes of the Event, according to the Clause 3.2 of the Rules.
8.2.2. Receipts received not at “Korzinka” stores are not accepted for participation in the Event.
8.3. Fiscal Receipts with no indication of Promotion Products, not complying with the requirements of the legislation of the Republic of Uzbekistan specified with regards to the form and content of cash register receipts, are not accepted for participation in the Event.
8.4. 1 (one) fiscal receipt with indication of not less than 2 (two) pieces of Promotion Products, purchased within the relevant period, specified in the Clause 9.2 of the Rules (Section “Period for purchasing the Promotion Product”), is considered 1 (one) application for participation in relevant Prize Giveaway (hereinafter referred to as the “Application) specified in the Clause 9.2 of the Rules (Sections “Date of determination of Winners” and “Number and type of Prizes”).
1 (one) fiscal receipt with indication therein of Promotion Products in at least 70 g Raffaello package equals to 1 (one) Application for participation in Promotion Prize Giveaway.
8.5. In case 1 (one) fiscal receipt contains more than 2 (two) pieces of Promotion Products, this receipt shall be considered as 1 (one) Application for participation in Promotion Giveaway;
8.6. The more Applications are submitted by the Participant (Promotion Products purchased) for participation in Giveaway within the relevant periods specified in the Clause 9.2 of the Rules (Section “Period for purchasing the Promotion Products”), the more chances the Participant has to win the Event (Event Prize(s) Holder).
8.7. In case the Participant has won the Event (has become holder of any Prize(s) of the Event), the Application, upon which the Prize has been won, is automatically superseded, and in order to continue participation in the Event the Participant must purchase the products once more, according to the Event Rules.
8.8. Purchased promotions include loyalty cards that have been identified and contain the current full name and phone number of the user.
9. DETERMINATION OF THE EVENT WINNER
9.1. During the entire Event Period the Promoter shall conduct:
-2 (two) Giveaways of the Weekly Prize (hereinafter referred to as the “Weekly Giveaway”),
- 1 (one) Giveaway of the Grand Prize (hereinafter referred to as the “Grand Giveaway”)
according to the Prize Giveaway Schedule (hereinafter referred to as the “Giveaway Schedule”) specified in the Clause 9.2 of the Rules.
9.2. Winners of the Weekly Prizes and the Grand Prize are determined randomly using randomus.ru/list software on the territory of the Republic of Uzbekistan among the Participants complied with the provisions set out in the Section 8 of the Rules within the relevant Periods (hereinafter referred to as the “Period for purchasing the Promotion Product”) specified in the “Giveaway Schedule” below and will announced on the official pages of @korzinkauz: :

*Giveaway Schedule may be adjusted by the Promoter taking into account weekends and holidays, determined by the legislation of the Republic of Uzbekistan, as well as in the event of circumstances beyond reasonable control of the Promoter or the Client.
9.3. Any Giveaway shall be conducted only if the number of registered Participants is 4 (four) times more than the number of the Prizes by the date of the Giveaway.
9.4. In case the Period for determination of the Winners expires, and the number of Participants registered by the date of the Weekly/Grand Giveaway does not comply with the Clause 9.3 of the Event Rules, determination of the Winners shall be reserved for the next Period for determination of the Winners, and the total number of Prizes to be distributed during the next Period for determination of the Winners, shall be increased by the number of Prizes that have not been distributed during the previous period.
9.5. On the date of the Giveaway and determination of the Winners the Promoter determines the Main and Reserve (Alternative) Winners (hereinafter referred to as the “Alternative Winner”). Number of the Main Winners within each Giveaway must be equivalent to the number of Prizes;
The Promoter determines the Alternative Winners for possible replacement of the Main Winner, in the event the Main Winner breaches the provisions of the Event or other non-compliance with the Event conditions.
The Event Promoter is not obliged to disclose the names of the Participants included in such list of Reserve (Alternative) Winners.
Results of all Giveaways shall be disclosed via social media on Instagram page of “Korzinka” retail chain.
9.6. Within 14 (fourteen) working day from the date of determination of the Winners, the Event Promoter shall contact the Winners by calling the Winner’s number, assigned to Korzinka Loyalty Card, for distribution of Prize(s). In case the Winner’s phone is out of range, or the Event Winner fails to answer the call within 14 days, or due to any other technical reasons beyond the control of the Technical Partner, as well as if the Winner does not give consent to provide his/her personal data to the Event Promoter, the Winner loses his/her chances of winning, without possibility to challenge decision of the Event Promoter, and the Prize shall be reassigned to the Alternative contestant. In case of lack of communication with the Alternative contestant, the Prize shall be transferred to the next Alternative contestant.
9.7. Phone number assigned to the Participant during registration of the Loyalty Card of “Korzinka” retail chain, must be kept assigned to the Participant within the entire Event Period specified in the Section 3 of the Rules. In the event of transferring the phone number to the third parties or changing the registered phone number, the Winner (and/or the Alternative contestant) loses the right to receive the Event Prize. Re-registration with different phone number is not allowed.
9.8. 1 (one) Participant can repeatedly take part in the Weekly Giveaways, subject to observing terms and provision specified in the Clauses 8.7 and 9.2 of the Rules, at the same time, 1 (one) Participant can receive not more than 1 (one) Prize under 1 (one) Weekly Giveaway for the entire period of the Event.
10. CONDITIONS/PROCEDURE FOR OBTANING PRIZES
10.1. In order to obtain Weekly and/or Grand Prize the Winner must provide consent to the Promoter for transfer of personal data to the Event Promoter, pursuant to the Clause 9.6 of the Event Rules.
10.2. In order to obtain Weekly and/or Grand Prize the Winner must, not later than 5 (five) days upon receiving notification from the Promoter (Clause 9.7 of the Rules), submit the following documents and/or personal information to the Promoter’s email at email@example.com (submit to the Promoter):
10.2.1. Winner’s full name;
10.2.2. Winner’s complete and exact residence address;
10.2.3. Duplex copy of the valid passport.
The Winner’s passport must contain IIN (Individual Identification Number).
10.2.4. In the absence of IIN of the foreign citizen, the IIN data is additionally provided in the document certifying residence permit in the Republic of Uzbekistan;
10.2.5. Photographs/scanned copies of the Loyalty Card of “Korzinka” retail chain with clear image of the number indicated on the Loyalty Card.
10.2.6. Photograph/scanned copy of Prize Distribution Certificate signed by the Winner, with further submission of signed original Prize Distribution Certificate to the Promoter via courier service;
10.2.7. Photograph/scanned copy of Consent on Personal Data Transfer and Processing to the Promoter, signed by the Winner, with further submission of signed original Consent on Personal Data Transfer and Processing to the Promoter.
10.3. The Event Winner who fails to follow the provisions of the Rules, lose the right to receive the Prizes (Weekly and/or Grand). In that case the Event Client disposes of such Prize at its own discretion.
10.4. Weekly/Grand Prizes of the Event shall be handed over to the Winner at the expense of the Promoter’s funds (at the Promoter’s discretion) via courier service at the residence address, stated by the Winner, according to the Clause 10.2.2 of the Rules, within 21 (twenty-one) days from the date of acknowledging such participant to be the Event Winner, and, when necessary to clarify the information/receive the documents - from the date of receiving the necessary information (documents), specified in the Clause 10.2, from the Winner, and subject to fulfilling all conditions of the Rules by such Event Winner.
10.5. The Event Participant loses the acquired right to receive the relevant prize without any compensation (including monetary) in the following cases, notwithstanding the time when the below circumstances become known:
10.5.1. if the Participant is recognized as the violator of the Rules prior to distributing the relevant prize to him/her;
10.5.2. if the Participant, verbally or in written form via the means of electronic communication, declares rejection to receive the prize;
10.5.3. if not possible to identify the Event Participant;
10.5.4. after 3 (three) failed attempts to contact such Winner;
10.5.5. in case of the Winner’s refusal to transfer personal data to the Promoter;
10.5.6. in case of the Winner’s refusal to submit within the set timeframe all necessary information specified in the Clause 10.2 of the Rules.
10.6. Client’s/Promoter’s obligations on distribution of prizes are considered completed from the moment of handing over the relevant prizes for delivery. Client/Promoter do not hold responsibility for action/lack of action by the courier service.
10.7. Right of ownership of the prize is transferred to the Winner upon receiving such prize. The Event Winner singlehandedly takes all measures related to disposal and use of the Event Prize owned by the Winner.
10.8. If not possible to deliver to/receive the Prize by the Event Winner before April 30, 2023 due to reasons beyond the control of the Client/Promoter, including, but not limited:
- deletion by the Winner of his/her email address or loss of access to the email address;
- the Winner indicating the wrong email address;
- failures, bugs and errors of computer systems, email servers, Internet service provider network;
- failures, bugs and errors of the Internet;
- lack/blockage of the Internet or electric energy supply;
- blockage of mail services and/or websites with the Winner’s email addresses by the state authorities, declaration of them being extremist or terroristic
such Event Prize is considered unclaimed, cannot be claimed by the relevant Winner again, and is disposed of by the Event Client at its own discretion.
10.9. The Event Participants hold responsibility for ensuring availability of their mobile numbers for incoming calls and text messages during the entire period of the Event.
10.10. The right to receive the Event Prize cannot be transferred by the Winner to a third party.
10.11. Exchange of the gained Prize for other Prizes of the Event is not allowed (excluding the Clause 7.5 of the Rules). Payment of the monetary equivalent of the prizes is not allowed. Replacement of the Weekly and/or Interim and/or Grand Prizes of the Event with the monetary or any other equivalent is not allowed. The Prizes are non-refundable.
10.12. The number of the Event Prizes is limited and is specified by the Rules. The Promoter’s obligations on distribution of Prizes to the Participants are limited by the total volume of the Prize Fund, stated in the Clauses 7.2, 7.3, and 7.4 of the Rules. Therefore, the Event Participant cannot claim any compensation, including monetary.
10.13. Based on the results of the Prize distribution, the Operator submits the information on the Winners to the tax authorities.
10.14. When distributing the Weekly and the Grand Prizes the Operator acts as the withholding agent and commits to pay the personal income tax to the budget of the Republic of Uzbekistan, according to the statutes of the tax legislation of the Republic of Uzbekistan, that is surcharged from the amount of any winnings (Clause 5 of Article 377 of the Tax Code of the Republic of Uzbekistan) at the rate of 12% (Article 381 of the Tax Code of the Republic of Uzbekistan) of the total amount of Prize from the monetary part of the Prize (if such monetary part is provided by the Rules). The Winner agrees to withhold and pay the personal income tax from the monetary part. The Operator commits to submit to the tax authorities the information on income gained by the Event Winner as a result of receiving the Prize.
11.EXPENDITURES. LIMITATION OF RESPONSIBILITY
11.1. Neither the Promoter nor the Client or the Technical Partner hold any responsibility for:
11.1.1. Participants’ failure to fulfill (untimely fulfilling) of the obligations related to participation in the Event and/or receipt of the prizes;
11.1.2. Failure to familiarize the Participants with the Event Rules, as well as failure to familiarize with the results of the Event;
11.1.3. Failure to receive from Participants the letters, calls and/or electronic communications, including through a fault of the postal service, communication providers, as a result of technical issues and/or Internet scam and/or communication channels used during the Event;
11.1.4. Failure to receive (untimely receiving) from Participants the documents and/or information needed to distribute the Prizes;
11.1.5. Receiving from the Participants incomplete and/or incorrect contact and/or other information, personal data needed for purposes of the Event and distribution of the Prizes;
11.1.6. Any technical failures, service maintenance, etc. of the mobile network operators, Internet service providers, occurred not through a fault of the Event Promoter;
11.1.7. Any costs and/or losses, incurred by the Participants in connection with participation in the Event and/or receipt of the Prize.
11.1.8. In case of force-majeure circumstances, including initiation of the emergency rule and/or sanitary-and-epidemiologic limitations/bans due to COVID-19.
11.2. All Event Participants pay all and any costs incurred by them in connection with participation in the Event (including and without limiting, costs related to use of Internet, obtaining any information on the Event, purchase of the Promotion Product etc.) by themselves.
11.3. Promoter and/or Client of the Event are not responsible for resolving any disputes regarding the rights for the Event Prizes. In any case the final decision regarding the disputes is made by the Client, and such decision is not subject to any appeal.
11.4. Neither the Promoter nor the Client enter into a dispute, in case of disputes about the possession of mobile phone number, email address, Promotional Product, receipt by a particular person. All such disputes are resolved between the parties to the conflict independently and at their own expense.
12.1. By participating in the Event, the Participant commits to provide accurate and up-to-date (reliable) data, and also, acting on his own will and in his own interests, provides the Client, Promoter, Operator and Technical Partner and their authorized persons with consent to the collection, processing, transfer, including cross-border, use, storage of personal data provided by the Participant and other information in cases and to the extent provided for by the legislation of the Republic of Uzbekistan, in particular by the Law of the Republic of Uzbekistan. "On Personal Data" dated June 21, 2019 No. ZRU-547, and the Rules.
Personal data of the Event Participants must be effectively secured, including unauthorized access from the third parties.
12.2. By participating in the Event, the Participant provides the Client, the Promoter and their authorized persons with the right to use his/her personal data, with prior written consent, photographs, interviews, phone numbers, email and/or other materials about him/her for the advertising and/or marketing purposes of the Client, including, but not limited to: the Client, the Promoter and the persons authorized by them are granted the right to publish the Participant's data and materials in the media, any printed publications, the Internet, without any restrictions on the territory, time and method of use; and such use will not be reimbursed (compensated) in any way to the Participant by the Promoter or the Client of the Event.
12.3. By participating in the Event, each Participant agrees, without limitation on the validity period, to receive SMS messages, news and other informational/advertising messages (mailouts) to his mobile phone number, email address from the Client, the Promoter and their authorized persons in the future.
12.4. The Participant has the right to refuse to receive this information at any time by sending a corresponding written message to the email address firstname.lastname@example.org.
12.5. Participants give their consent that the personal data and information voluntarily provided by them for the purposes of the Event will be processed by the Promoter and/or the Operator and Technical Partner, as well as by their authorized persons using automated data processing tools.
12.6. The Participant has the right to withdraw the Consent provided in accordance with the Clause 12.2. of the Rules at any time. In case of receiving a notification of withdrawal of the Participant's Consent, the Promoter, the Client and/or their authorized persons stop processing the personal data of such Participant and dispose of the personal data within a period not exceeding ten working days from the date of receipt of the withdrawal. At the same time, the Participant's further participation in the Event and receipt of the Event Prizes is not allowed.
12.7. Consent to the processing, collection, transfer, including cross-border, use, storage of personal data and information is provided by the Event Participant for a period from the date of the beginning of the Event and is valid through December 31, 2023 inclusive. Personal data and information of the Event Participants are stored and processed in accordance with the requirements of the legislation of the Republic of Uzbekistan subject to confidentiality until the expiration of the period specified in this Clause of the Rules, after which the Participants' personal data and information are subject to deletion by the Promoter and/or the Client.
13. MISCELLANEOUS PROVISIONS
13.1. By participating in the Event the Participant confirms:
13.1.1. Familiarization and his/her full and unconditional consent to all Rules and conditions for participation in the Event.
13.1.2. His/her consent to the use of photographic materials with his image, interviews and other materials with his participation by the Promoter and/or the Client for the purpose of advertising and/or announcing the Event, "Raffaello" trademark, without payment of remuneration to the Participant.
The Participant hands over to the Promoter the right to use such materials, by broadcasting, public display, as well as other non-exclusive copyrights, for the purpose of public advertising and/or announcing the Event and its results, as well as "Raffaello" trademark;
13.1.3. The Promoter reserves the right to edit the materials related to the Participant before posting them in the media, on the Website, on the Internet without prior agreement with the Participant.
13.2. The Event Promoter has the right, at its own discretion, without explaining the reasons to the Participants and without entering into correspondence with them, to invalidate any actions of the Event Participants, as well as to prohibit further participation in the Event, to refuse to distribute a Prize to any person in respect of whom the Promoter has reasonable suspicions that the Participant is falsifying the data or extracting benefit from any data deception.
13.3. By participating in the Event, each Participant agrees, without limitation on the validity period, to receive text messages, news and other informational/advertising messages (mailouts) to his/her mobile phone number, email address from the Client or their authorized persons in the future.
The Participant has the right to refuse to receive such information at any time by sending a corresponding written message to the following email address: email@example.com.
13.4. In the event of a situation that allows for an ambiguous interpretation of the Rules, any matters of dispute and/or issues not regulated by the Rules, the final decision is made by the Client in accordance with the requirements of the applicable legislation of the Republic of Uzbekistan. All claims and disputes shall be received by the Client.
13.5. In all matters not covered by the Rules, the Promoter/Client/Technical Partner, Event Participants are guided by the applicable legislation of the Republic of Uzbekistan.
