PROMOTIONAL CAMPAIGN RULES
OREO Whichever flavour you choose at Korzinka retail chain
(HEREINAFTER REFERRED TO AS THE RULES)
 

1.  The OREO Whichever Flavour You Choose Promotional Campaign in Korzinka retail chain (hereinafter referred to as the Promotion) is held among an unspecified circle of people in order to create and maintain interest, create a positive image and consumer demand for the products under the Oreo® trademark as well as to increase sales of such products. The Promotion is not a lottery gambling and does not require Participants to pay a participation fee.
 

2. INFORMATION ON THE CUSTOMER, ORGANIZER, TECHNICAL PARTNERS
OF THE PROMOTIONAL CAMPAIGN

2.1   The Customer for the Promotional Campaign: Mondelez Rus LLC (hereinafter referred to as the Customer), located at the following address: 10 Franz Stolverk Street, Petushinsky District, Vladimir Region, Pokrov, Russia, 601123, INN: 3321020710.
2.2   Promotional Campaign Organizer: The Organizer of the Promotional Campaign is Urban Media LLP (hereinafter referred to as the Organizer), a legal entity incorporated under the laws of the Republic of Kazakhstan, BIN 050840004119, located at the following address: Office 2104, 10th Floor, Block 2, 135 Zhibek Zholy Avenue, Almaty, acting on behalf of the Customer.
2.3. Promotional Campaign Operator: UrbanMedia Alliance LLC (hereinafter referred to as the Operator), a legal entity incorporated under the laws of the Republic of Uzbekistan, located at the following address: Room 116, 1st Floor, BC Bobur 77, Tashkent City, 1000, Republic of Uzbekistan, Taxpayer Identification Number 306708505.
2.4 Promotional Campaign Information Partner (hereinafter referred to as the Information Partner): IE ANGLESEY FOOD LLC, legal entity established in accordance with the legislation of the Republic of Uzbekistan, INN 202 099 756, located at the following address: Beshyogoch Bazaar, 57 Turob Tula Street, Tashkent City, 100066, Republic of Uzbekistan.
 

3.TERM OF PROMOTIONAL CAMPAIGN

3.1 Promotional Campaign period: from 1st May 2023 to 30th June 2023 (inclusive) (hereinafter referred to as the Campaign Term or the Campaign Period).
3.2 Term for purchase of Promotion Products: from 1st May 2023 to 30th June 2023 (inclusive).
3.3 Term allocated for determining the Winners of the Promotional Campaign: from 2nd May 2023 to 5th July 2023 (inclusive) according to the Prize Draw Schedule specified in clause 9.2 of the Promotional Campaign Rules
3.4   Deadline for delivery of the Prizes to the Winners of the Promotional Campaign: until 15th July 2023 (inclusive).
3.5 All terms specified in these Rules shall be calculated at the time of Tashkent City, Republic of Uzbekistan.
 

4.TERRITORY, PROMOTIONAL SITE AND INFORMATION PROCEDURES

4.1. The promotional campaign is held in the territory of the Republic of Uzbekistan (hereinafter referred to as RUz.) in Korzinka, Korzinka DISKONT and Smart supermarket chains, located in the territory of the Republic of Uzbekistan, except Korzinka DISKONT supermarkets, operating under franchise and located at the following addresses: Republic of Karakalpakstan, Nukus, 162 Ernazar Alakuz Street and Kashkadarya Region, Shakhrisabz, 35 Maftunkor Street (hereinafter referred to as the Campaign area).
4.2   The Participants shall be informed of the rules for participating in the Promotional Campaign, terms and conditions of the Campaign (including amendments and additions thereto) through:
1)    official website of the Information partner of the Promotional Campaign https://korzinka.uz/(above, hereafter referred to as the Website)
2) other means at the discretion of the Operator, Organizer and/or the Customer.
3) Email for questions about the Promotional Campaign: consumercareeua@mdlz.com
4.3   The Organizer and/or the Customer shall have the right at any time to change the conditions of the Promotional Campaign, terminate it prematurely, and publish additional information about the Promotional Campaign. The updated (additional) information on the Promotional Campaign and its terms shall be posted on the Website within 3 (three) working days from the date of approval of such change (update) by the Customer.
4.4   The Customer, Organizer, Operator and Information Partner reserve the right not to enter into written negotiations or any other contact with the Participants of the Promotional Campaign, except as provided by these Rules, the current legislation of the Republic of Uzbekistan, and in the event of a dispute.
4.5   The Organizer and the Employer are fully responsible for holding and the results of the Promotional Campaign.
4.6. IE Anglesey Food LLP and Korzinka retail chain stores shall not accept applications and complaints regarding the Promotional Campaign and shall not be liable for holding and the results of the Promotional Campaign.
 

5. PROMOTIONAL PRODUCT

5.1 The Promotional Campaign applies to the products listed below under the Oreo® trademark (hereinafter referred to as the Promotional Product):

5.2. The Promotional Products must be purchased by the Participant within the period specified in clause 3.2. of the Promotional Rules, in Korzinka retail chain, in accordance with clause 4.2 of the Promotional Rules and/or through Korzinka Go delivery service, as well as in accordance with the Prize Draw Schedule specified in clause 9.2 of the Promotional Rules (Term allocated for purchase of Promotional Products section).
 

6. PARTICIPANTS OF THE PROMOTIONAL CAMPAIGN

6.1. Eligible individuals aged 16 years and above may participate in the Promotional Campaign: citizens of the RUz and foreign nationals holding a residence permit in the RUz and residing in the territory of the RUz who are registered in the Loyalty Program of Korzinka retail chain (hereinafter referred to as the Loyalty Program) and are holders of a valid /active Loyalty Card of Korzinka retail chain (hereinafter referred to as the Loyalty Card or the Korzinka Loyalty Card), (hereinafter referred to collectively as the Participants, and each individually as the Participant).
6.2 The persons aged between 16 and 18 are allowed to participate in the Promotional Campaign only with the consent of their parents, guardians or other persons referred to in this clause of the Rules provided they have full legal capacity.
6.3 The following categories are not allowed to participate in the Promotional Campaign:
-employees of the Customer and/or Organizer, Operator and Information Partner;
-individuals recognized as affiliated to the Organizer, Operator, Information Partner and Customer;
-employees and representatives of third parties having established civil and other relations with the Organizer, Operator, Information Partner, Customer, and/or affiliated with the organization and (or) holding of the Promotional Campaign, sales of the Customer's products;
-close relatives of the persons listed above;
-stateless persons and citizens of other states who do not have residence permits in Uzbekistan;
6.4 If it is revealed that citizens who do not comply with clauses 6.1, 6.2, 6.3. and other sections of these Rules take part in the Promotional Campaign, the Organizer and/or the Operator shall have the right to refuse such persons to take part in the Promotional Campaign and (or) to receive the prize.
 

7. PROMOTIONAL CAMPAIGN PRIZE FUND

7.1 The Promotional Campaign Prize Fund is formed from the Customer's funds and includes the Daily, Weekly and Main Prizes (hereinafter referred to as the Promotional Campaign Prizes).

7.2 Daily prizes:

·         Korzinka certificate with a nominal value of 100,000 (one hundred thousand) soums - 610 (six hundred and ten) pieces for the entire Promotional Campaign Period;
Validity period of Korzinka certificate with a nominal value of 100, 000 (one hundred thousand) soums
- until 31.12.2023.

7.3 Weekly prizes:

·         Apple Airpods 3rd Generation Wireless Headphones with Charging Case - two (2) pieces for the entire Promotional Campaign Period;
·         JBL Flip 5 Portable Speaker System - two (2) pieces for the entire Promotional Campaign Period;
·         Xiaomi Mi daypack backpack - five (5) pieces for the entire Promotional Campaign Period;

7.4 Main prize:

·         Apple Iphone 14 (128GB/White) - 1 (one) item for the entire Promotional Campaign Period. The Customer reserves the right to change the Promotional Campaign Prize Fund, including changing the quantity, configuration, type and other characteristics of the Prizes. In this case, the Prizes must be commensurate in value with those replaced.
7.5. The Customer reserves the right to change the Promotional Campaign Prize Fund, including changing the quantity, configuration, type and other characteristics of the Prizes. In this case, the Prizes must be commensurate in value with those replaced.
7.6. The layout of the Promotional Campaign Prizes, their size, form, packaging colour and other characteristics may not coincide with the images presented in the advertising materials and personal expectations of the Participants. The manufacturer of these products takes full responsibility for the quality of the products provided as the Promotional Campaign Prizes.
 

8.TERMS AND CONDITIONS AND PARTICIPATION RULES FOR THE
PROMOTIONAL CAMPAIGN

In order to participate in the Promotional Campaign, the Participant must perform the following sequence of conclusive actions during the Promotional Campaign Period specified in Section 3 of these Rules:
8.1. Purchase at least one (1) unit of the Promotional Product in one (1) fiscal receipt as specified in Section
5.1. herein during the period specified in Section 3.2 and Section 9.2 herein (Term for purchasing Promotional Products Section) in any Korzinka retail chain store specified in Section 4.2 and/or via Korzinka Go delivery service using Korzinka Loyalty Card (mandatory condition);
8.2 The number of Promotional Products to be purchased by the Participant is unlimited;
8. 3. 1 (one) fiscal receipt with at least 1 (one) unit of the Promotional Product purchased during the respective period specified in clause 9.2 of these Rules (Term for purchasing Promotional Products section) is 1 (one) Application for participation in the respective Prize Draw (hereinafter referred to as the Application) specified in clause 9.2. of these Rules (Deadline for Determining Prize Winners and Number and Type of Prizes sections). 1 (one) fiscal receipt, with 1 (one) unit or more of the Promotional Product indicated on it = 1 (one) Application for participation in the Promotional Campaign Prize Draw.
8.4 If 1 (one) fiscal receipt contains more than 1 (one) unit of the Promotional Product, this fiscal receipt will
be considered as 1 (one) Application for participation in the Promotional Campaign Prize Draw;
8.5 The more Applications are submitted by the Participant (purchased Promotional Products) to participate in the Prize Draw during the respective periods specified in clause 9.2. of the Rules (Term for purchasing
Promotional Products section), the higher their chances of becoming a Winner of the Promotional Campaign (winner of the Prize/Promotional Campaign Prizes).
8.6   If the Participant becomes the winner of the Promotional Campaign (winner of any of the Promotional Prizes/Prizes of the Promotional Campaign), the Application (fiscal receipt) for which the Prize was won will be automatically cancelled and the Participant will have to purchase the products again in accordance with the Promotional Campaign Rules for subsequent participation in the Promotional Campaign.
 

9. DETERMINING THE WINNERS OF THE PROMOTIONAL CAMPAIGN

9.1 During the entire Promotional Campaign Period, the Organizer will hold:
- 61 (sixty-one) Daily Prize Draws (hereinafter referred to as the Daily Draw),
- 9 (nine) Weekly Prize Draws (hereinafter referred to as the Weekly Draws),
- 1 (one) Grand Prize Draw (hereinafter referred to as the Grand Prize Draw)
according to the Promotional Campaign Prize Draw Schedule (hereinafter referred to as the Prize Draw Schedule) as defined in clause 9.2 hereof.
9.2   The winners of the Daily Prize, Monthly Prize and Grand Prize are determined randomly by a random number generator located on Random.org on the web, among the Participants who fulfil the conditions set out in Section 8 of the Regulations during the relevant Periods (hereinafter referred to as the Term for purchasing Promotional Products) set out in the Prize Draw Schedule below:

  *The Prize Draw Schedule may be adjusted by the Organizer taking into account weekends and public holidays established by the legislation of the Republic of Uzbekistan, as well as upon the occurrence of circumstances beyond the control of the Organizer and the Customer.
9.3. Any Draw is held only if the number of registered Participants of the Promotional Campaign by the Draw date exceeds the number of Prizes to be drawn by at least four (4).
9.4. In the event that the period for determining the Prize Winners has expired and the number of Registered
Participants by the date of the Daily/Weekly/Main Draws does not comply with clause 9.3 of these Promotional Campaign Rules, the determination of potential Prize Winners shall be postponed to the next period of determination of the Winners, and the total number of Prizes to be distributed in the next period of determination of the Prize Winners is increased by the number of Prizes not distributed in the previous period.
9.5.   On the Draw Days and Prize Winner Days the Organizer shall determine the Main Winners and Alternative Winners (hereinafter referred to as the Alternative Winner). The number of the Main Winners in each Draw shall be equivalent to the number of Prizes drawn;
The number of Alternate Winners within each draw is:
- Daily draw - five (5) participants,
- Weekly draw - two (2) participants,
- Grand Prize draw - two (2) participants.
The Organizer shall determine the Alternative Winners for potential replacement of the Main Winner if the Main Winner violates the conditions of the Promotional Campaign or otherwise fails to meet the conditions of the Promotional Campaign.
The Promotional Campaign Organizer is not obliged to disclose the names of the Participants who have been included in the list of Reserve (Alternative) Winners.
9.6. Within 3 working days from the date of determining of the Prize Winners, the Operator shall contact the Winners by calling them on the telephone number of the Winner assigned to Korzinka Loyalty Card to find out the information required to deliver the prize. If the phone number of the Promotional Campaign Winner is out of reach or the Winner does not answer the phone within 72 hours or for any other technical reasons beyond the control of the Promotional Campaign Organizer, the Winner will lose the chance to win without the possibility to dispute the decision of the Promotional Campaign Organizer, and the Prize will be reassigned to the Alternative Winner. If the Alternative Winner may not be contacted, the Prize will be transferred to the next Alternative Contender and so on.

9.7. The Participant’s mobile phone number registered on Korzinka Loyalty Card

must be retained by the Participant during the entire Promotional Campaign Period specified in Section 3 of these Rules. In case of alienation of the mobile phone number to a third party or change of the registered mobile phone number, the Winner (and/or an Alternative Winner) shall lose their right to receive the Promotional Prize. Re-registration with a different phone number is not allowed.

9.8. 1 (one) Participant may participate in the Daily Draw more than once, subject to meeting terms and conditions specified in clause 7.1, clause 9.2 of these Rules.

The Participant is entitled to no more than 1 (one) prize within 1 (one) Daily Draw and no more than 5 (five) Daily prizes over the entire Promotional Campaign Period.

9.9. One (1) Participant may receive a maximum of one (1) Weekly Prize for the entire Promotional Campaign Period.

9.10.           1 (one) Participant may win a maximum of 1 (one) Grand Prize for the entire Promotional Campaign

Period.


TERMS AND CONDITIONS/PROCEDURE FOR RECEIVING PRIZES

10.  To receive a Daily and/or Weekly and/or Grand Prize the Winner shall provide to the Information Partner the consent to transfer personal data to the Organizer and/or Promotional Campaign Operator in accordance with the terms and conditions of clause 9.6 of the Promotional Campaign Rules.

10.1.   In order to receive the Daily/Weekly/Grand Prize, the Winner must within two (2) calendar days of receipt of the notice from the Operator (clause 9.7. of these Rules) send an email to Operatoruz@urbanmedia.uz (provide to the Operator) with the following documents and/or information: 10.1.1 Surname, first name, patronymic name (if any) of the Winner;
10.1.2. Full and correct address of the Winner's actual place of residence;
10.1.3. Photo/scanned copy of a valid passport from two (2) sides.
The Winner's passport must contain an Individual Identification Number (IIN).
10.1.4. If a foreign national has no IIN in their residence permit document in the Republic of Uzbekistan, the IIN data shall be provided additionally;
10.1.5. Photos/scanned copies of Korzinka loyalty card with a clear picture of the number indicated on the loyalty card.
10.1.6. A photo/scanned copy of the Prize Delivery Certificate signed by the Winner (hereinafter referred to as the Prize Delivery Certificate) with further submission of the signed original of the Prize Delivery Certificate to the Organizer by courier service (the form of the Prize Delivery Certificate is provided to the Participant by the Operator in advance as part of the notice under clause 9.6. of the Promotional Campaign Rules).
10.1.7. A photo/scanned copy of the Personal Data Transfer Consent (hereinafter referred to as the Personal Data Transfer Consent) to the Organizer/Operator signed by the Winner, with further submission of the signed original of the Consent to the Organizer by courier service (Personal Data Transfer Consent form is provided to the Participant by the Operator in advance in the notice under clause 9.6 of the Promotional Campaign Rules).
10.2. The Promotional Campaign Winner who fails to comply with these rules loses the right to receive the Prizes (Daily/Weekly/Grand Prize). In such case the Promotional Campaign Customer shall dispose of such Prize at their sole discretion.
10.3. Delivery of the Daily / Weekly / Grand Prize to the Promotional Campaign Winners residing in the cities of Ruz, except for Tashkent. The delivery shall be performed by the courier (postal) service authorized by the Organizer to the address of actual place of residence specified by the Winner as per clause 10.1.2. of these Rules within 25 (twenty-five) calendar days from the date of recognition of such Winner, and in case of necessity to specify information / obtain documents - from the date of receipt of necessary information (documents) from the Winner as specified in clause 10.1 provided the Winner fulfills all conditions of these Rules.
All prize delivery costs are at the Customer's expense.
10.4. The Winners of the Daily / Weekly / Grand Prize in Tashkent City will collect the Prizes independently at the location of the Operator. The Operator’s address will be provided to the Winner additionally.
The costs related to travelling to the place where the prize is collected are not covered by the Organizer, Operator or Customer.
10.5. The Promotional Campaign Participant shall lose their acquired right to receive the relevant prize without any compensation, including monetary compensation, in the following cases, regardless of the time at which the above circumstances became known:
10.5.1. if the Participant is found to be in breach of these rules before the relevant prize is awarded;
10.5.2. if the Participant declares their refusal to receive the prize orally or in writing via electronic means of communication;
10.5.3. if the Participant cannot be identified;
10.5.4.after three (3) unsuccessful attempts to contact such Winner;
10.5.5. if the Winner refuses to pass their personal data to the Organizer/Operator of the Promotional Campaign;
10.5.6. if the Winner refuses to provide all necessary information specified in clause 10.1 of these Rules within the stipulated time limits.
10.6. The Customer's/Organizer's/Operator's liability for delivering the prizes is deemed fulfilled as soon as the relevant prizes have been handed over to the courier service for dispatch. The Customer/Organizer/Operator shall not be responsible for the actions/failure to act on behalf of the courier service.
10.7. The title to the prize shall be transferred to the Winner from the moment such prize is awarded to them. The Winner of the Promotional Campaign shall independently take all measures related to the sale and use of the Promotional Campaign Prize belonging to them.
10.8. If the Promotional Campaign Organizer/Customer may not send/deliver the Prize to the Promotional Campaign Winner by 15th July 2023 for reasons beyond their control, including but not limited to
- the Winner deletes the email address or loses access to the email address.
- the Winner provided an incorrect e-mail address.
- failures, malfunctions and errors in computer systems, mail servers and internet service provider's network.
- Internet failures, errors and malfunctions.
- no/blocked internet, electricity.
- the government authorities block mail services and/or websites with the email addresses of the Promotional Campaign Winner and recognise them as extremist and/or terrorist
such Promotional Campaign Prize shall be deemed unclaimed, cannot be claimed by the relevant Winner again, and is used by the Promotional Campaign Customer at own discretion.
10.9.     The Promotional Campaign Participants are responsible for ensuring that their mobile numbers are able to receive incoming calls and incoming text messages throughout the Promotional Campaign Period.
10.10. The right to receive the Promotional Campaign Prize may not be transferred by the Winner of the Promotional Campaign to any third party.
10.11. It is not allowed to replace the prize won with other prizes in the Promotional Campaign (except for clause 7.4. of these Rules). The cash equivalent of the prizes shall not be paid out. The Weekly and (or) Grand Prize of the Promotional Campaign may not be replaced with cash or any other equivalent. Prizes are non- refundable.
10.12. The number of prizes of the Promotional Campaign is limited to the amount specified in section 7 of these Rules. The Organizer's obligations to deliver the prizes to the Participants are limited to the total amount of the Prize Fund specified in clause 7.2, clause 7.3, and clause 7.4 of these Rules. In this connection, the Participant of the Promotional Campaign cannot claim any compensation, including monetary compensation.
10.13. An individual who received a prize as part of participation in the Promotional Campaign under a public offer, lasting more than 30 days, in accordance with clause 14, paragraph 2 of Article 369 of the Tax Code of the Ruz shall not pay income tax for individuals. The Winner shall make other payments and pay duties and fees into the Ruz budget (or) budget of other countries, including commission and other additional payments in connection with the receipt, possession, and disposal of the prize of the Promotional Campaign.


11. RESPONSIBILITIES. LIMITATION OF LIABILITY

11.1 The Organizer and the Customer shall not be liable for the following:
11.1.1   Failure to fulfil (non-timely fulfilment) by the Participants of their obligations in connection with participation in the Promotional Campaign and/or receipt of prizes.
11.1.2 Failure of the Participants to familiarize with the Promotional Campaign Rules and failure to familiarize with the results of the Promotional Campaign.
11.1.3 Failure to receive letters, calls and/or emails from Participants, including due to the fault of the postal service, communication organizations, due to technical problems and/or fraud on the Internet and/or communication channels used during the Promotional Campaign.
11.1.4 Failure to receive (late receipt) documents and/or information from the Participants required to claim the Prizes.
11.1.5 Receipt of incomplete and/or incorrect contact and/or other information, personal data required for the purposes of the Promotional Campaign and transfer of the Prizes from the Participants.
11.1.6.    Any technical failures, malfunctions, preventive maintenance, etc of cellular operators, Internet providers, arising through no fault of the Organizer/Operator of the Promotional Campaign.
11.1.7. Any costs and/or losses incurred by the Participant in connection with participation in the Promotional Campaign and/or receipt of the Prize.
11.1.8.    in the event of force majeure events (force majeure), including a state of emergency and/or sanitary/epidemiological restrictions/prohibitions in connection with COVID-19.
11.2.          All participants of the Promotional Campaign shall pay all and any costs incurred by them in connection with participation in the Promotional Campaign (including and without limitation, costs related to the use of Internet, receipt of any information about the Promotional Campaign, purchase of promotional product, etc.).
11.3.           The Operator and/or the Organizer and/or the Customer of the Promotional Campaign are not liable in respect of any disputes regarding the right to prizes of the Promotional Campaign. In any case, the final decision regarding disputes shall be made by the Customer and such a decision shall not be subject to appeal.
11.4.          Neither the Organizer, nor the Customer or the Operator shall enter a dispute, in the event of a dispute over whether the mobile phone number, email address, Promotional Product, Korzinka Loyalty Card belongs to one or another person. All such disputes shall be resolved between the parties to the dispute on their own and at their expense.


12. PERSONAL DATA

12.1 By participating in the Promotional Campaign, the Participant undertakes to state accurate and uptodate (accurate) data and by acting on their own will and interests shall provide to the Operator, Organizer, Customer, Information Partner, and their authorised persons consent for the collection, processing, transfer, including cross-border transfer, use, storage of personal data and other information provided by the Participant in cases and to the extent provided by the legislation of the RUz, in particular the Law of the RUz. No. ZRU-547 of June 21, 2019, on personal data and these Rules.
The personal data of the Participants of the Promotional Campaign must be securely protected, excluding unauthorised access to it by third parties.
12.2 By participating in the Promotional Campaign, the Participant gives the Organizer, Customer, Information Partner, and their authorized persons the right to use their personal data, with prior written consent, including photos, interviews, phone numbers, e-mail and (or) other materials about them in advertising and (or) marketing purposes of the Client, in particular, but not limited to: The Customer, Organizer, Information Partner, and their authorised persons are granted the right to publish the Participant's data and materials in the media, any printed publications, Internet, without any restrictions on the territory, time and manner of use; and such use will in no way be compensated (paid for) to the Participant by the Promotional Campaign Organizer or Customer.
12.3 By participating in the Promotional Campaign, each Participant agrees without time limit to
receive SMS messages, news and other information/promotional messages (mailings) from the Customer, Organizer, persons authorised by them in the future, to their mobile phone number and e-mail address.
12.4 The Participant has the right to refuse to receive the said information at any time, by writing to consumercareeua@mdlz.com
12.5 The Participants consent to the fact that the personal data and information provided by them voluntarily for the purposes of the Promotional Campaign shall be processed by the Organizer and/or Operator and (or) the Information Partner, as well as by persons authorized by them, using automated data processing means.
12.6 The Participant shall have the right to withdraw the Consent provided under clause 12.2 of the Rules at any time. If the Organizer, Customer and (or) their authorized persons receive a notice of withdrawal of the Participant's Consent, they shall suspend processing the personal data of such Participant and destroy the personal data within a period not exceeding ten business days from the date of receipt of such withdrawal. In this case, further participation of the Participant in the Promotional Campaign and receipt of the Promotional Campaign Prizes by the Participant shall not be allowed.
12.7 The consent for the processing, collection, transfer, including cross-border transfer, use, storage of personal data and information shall be provided by the Participant of the Promotional Campaign for the period from the start date of the Promotional Campaign and shall be valid until 31.12.2023, inclusive. Personal data and information of the Participants of the Promotional Campaign shall be stored and processed in accordance with the requirements of the legislation of the Ruz on conditions of confidentiality until the expiration of the period specified in this clause of the Rules, after which personal data and information of the participants are subject to destruction by the Organizer and (or) the Customer.



13. MISCALLANEOUS PROVISIONS

13.1 By participating in the Promotional Campaign, the Participant acknowledges
13.1.1.   familiarization and consent and own full and unconditional acceptance of all Promotional Campaign Rules and terms and conditions.
13.1.2.   their consent to the use of photo materials with their image, interviews and other materials with their participation by the Organizer and (or) Customer and (or) Information Partner for the purposes of advertising and (or) announcement of the Promotional Campaign, Oreo® trademark without payment of remuneration to the Participant.
The Participant assigns to the Organizer and/or the Customer and/or the Information Partner the right to use such materials, by broadcasting, public display, equally other non-exclusive copyrights, in order to publicly advertise and/or announce the Promotional Campaign and its results, as well as the Oreo® trademark;
13.1.3 The Organizer and/or the Customer and/or the Information Partner reserve the right to edit materials relating to the Participant in the media, on the Website, on the Internet without prior agreement with the Participant.
13.2. The Promotional Campaign Organizer may at their sole discretion without explaining the reasons to the Participants and without entering into correspondence with them, invalidate any actions of the Participants of the Promotional Campaign, as well as prohibit further participation in the Promotional Campaign, deny the Prize to any person in respect of whom the Organizer has reasonable suspicion that the Participant is forging data or is benefiting from any data forgery.
13.3 By participating in the Promotional Campaign, each Participant consents, without limitation in time, to receive, on their mobile phone number, e-mail address, text messages, newsletters and other information/promotional messages (mailings) from the Customer, and persons authorized by them in the future. The Participant has the right to refuse to receive the said information at any time by sending a corresponding written message to the e-mail address consumercareeua@mdlz.com.
13.4 In the event of a situation that allows for an ambiguous interpretation of these Rules, any disputes and/or issues not regulated by these Rules, the final decision shall be made by the Customer in accordance with the requirements of the current legislation of the Republic of Uzbekistan. All claims and disputes shall be accepted by the Customer.
13.5. In all matters
not covered by these Rules, the Organizer/Operator/ Customer/Information Partner
and the Participants of the Promotional Campaign
shall be governed by the applicable laws of the Republic of Uzbekistan.
